Green Carded Thai Visiting Thailand

Featured Replies

My wife wants to go to thailand from hawaii for 3 weeks in december. We'v been in hawaii 7 months now on a marriage-permanent visa.

Is this allowed and what paperwork do we need for her?

If she has her greencard already, then she can go using her Thai passport. She should take her greencard with her, because she will need it to board the plane coming back to the US and at immigration. Nothing else needed.

As long as she does not stay out longer than one year, it will not be a problem. If she is out more than 6 months it can delay her getting citizenship if she wants it.

If you have been married less than 2 years she has a conditional green card and will need to apply for advanced parole to leave the country and be allowed to return. I understand that it takes a few months to process but it seems you have plenty of time.

Not true. My wife traveled several times on her conditional greencard.

A greencard, whether conditional or otherwise will allow you to reenter the US. Advanced parole is only needed during the period when you adjust status (file for the greencard) and when you receive the greencard, which could be up to a year.

The conditional part of the conditional permenant resident just means that you have not been married for 2 years. So they do not give you one for 10 years until you have been married/in the US for 2 years. This is to prevent visa fraud and fake marriages, the figure that if you have to come back in two years and still be married, and have lived together, that it would not be as enticing for people to have fake marriages.

Agree with jstumbo...Don't forget to bring your greencard with you and don't stay outside the country for too long though...Good luck

I stand corrected...
