Stopped At Heathrow This Morning

My wife was stopped at Heathrow this morning and told she could not leave the UK unless she signed a document cancelling her ongoing Judicial Review we have against the Home Office regarding an incorrect refusal of an FLR(O). The Immigration Officer got on the mobile to me informing me that she must sign to leave and in any event her leaving automatically cancelled the JR. He said they see this all the time. After challenging him her did a 'U' turn and let her through with out signing.

Our immigration solicitor advised us last week that if we wish to withdraw the JR at a date in the future it would cost us £75. Is this a trick by the immigration to strong arm the unsuspecting into cancelling actions against the HO ?????????????

All immigration-related in-country appeals are deemed to be withdrawn if the appellant leaves the U.K. However, J.R. is a different issue and your wife can pursue it whether she is in or outside the UK.

Had the IO made her sign, it would have been interesting to see the High Court's take on it.

I wonder what brought your wife to the IO's attention? Do they keep a list of who has pending JRs?

Would the High Court consider the IO's deceptive actions as being in contempt of court, or an attempt to pervert the course of justice?

As soon as they imputed her passport info it was fragged up on there PC at the desk. I spoke to my wife at length this morning and she told me that they really didnt want her to call me and tryed to strong arm her into signing. It is only down to the fact that her english is excelent and her strong whill that she faced them down and refused to budge with out talking to me.. IO told me that yes they have all the records of pending JR's. in their system.

Big brother is everywhere.
