popsicle Posted October 29, 2008 Posted October 29, 2008 I'm Thai and I run a small consultancy in Bangkok. I have no other Thai staff. I have two Americans that work with me, and would like to offer them visas so they don't have to do anymore border runs. I heard that there are consultant visas, anybody know the details? Or how i should go about to get Visas? thanks.
Mario2008 Posted October 29, 2008 Posted October 29, 2008 As I understand it is a consultancy visa only for short -time. Have a look here: http://www.immigration.go.th/nov2004/2notice/rtp606EN.pdf point 7.14. It won't do in your case. Your employers need to apply under 7.1 for which you need to have a lot of capital. Do they have a work permit already?
popsicle Posted October 29, 2008 Author Posted October 29, 2008 i'm thai, so i won't be needing a visa. are there any types of visas i can offer my two foreigners, without having to register such a large capital?
Mario2008 Posted October 29, 2008 Posted October 29, 2008 I understood that you are Thai and that this is about your employers. I was wondering if they have a work permit, otherwise they are working illegaly. But if they have they, already have a visa. Your orgiginal posting suggest they are working illegaly, making them and you breaking the law. Can't give you much imformation as how to deal with the capital requirement, as I don't know much about setting up a company. My understanding is that you also need Thai staff. The capital mentioned is registered capital, it includes things like knowlegde and computers the company owns. Others more knowlegable can give you better advise then me. But be carefull, right now you risk a fine.

phaethon Posted October 29, 2008 Posted October 29, 2008 An employer employs employees Hmmm... Do you mind if I write that down...?
hansnl Posted October 29, 2008 Posted October 29, 2008 An employer employs employees Hmmm... Do you mind if I write that down...? He who writes much, forgets much. And then there is the problem of pen and paper. Either one or both tend to be missing. That, dear students, brings the art of writing to its right proportions. It is a poor substitute for a well working, trained an pickled memory. Dear Popsicle, I am so sorry, when being on the wrong side of an half empty botlle, I tend to talk off the subject
simon43 Posted October 29, 2008 Posted October 29, 2008 If your business is a registered sole-trader business, then you should be able to obtain WPs for them, but only on the basis of 1 WP for every 4 Thai employees. (That is a requirement for WPs for sole-trader enterprises, and not to be confused with visa-extension requirements for limited companies). Do you employ 8 Thai staff? If so, you may be able to get WPs for your 2 foreign staff. I say 'may' because my local labour office here in Phuket still refused me a WP, even though Thai law clearly states that it is allowable for such a sole-trader business. Simon
