Tax query

I worked for an agency in 2006 and 2007 and they say they have not paid any tax but will not give me tax summarization forms

They say I only have to pay for 2008 but I believe under the bi-lateral tax agreement with the UK if one stays longer than 2 years then one must pay all back taxes which in my case includes 2006 and 2007.I arrived in September 2006 and my first salary payment was for November 2006.

I have no issue in paying the tax, I just want the agency to give me the forms as my previous employers have kindly accepted my requests and they were Government schools.

I do have all my salary statements from the agency but the Revenue Department will not accept them the statements or the contract.

I am happy to pay the tax and be responsible for it but I have hit a brick wall with the agency and the Revenue Department.

I will be leaving Thailand on the 23rd March and really need to get all this sorted out by Friday 20th March.

You didn't make enough in 2006 to owe any taxes. It's not worth it for the revenue office, or you, to worry about it.

For 2007, if the revenue office doesn't want your money, why push it? Are you square with them for 2008? If so, why not just enjoy the remainder of your time here before heading off home.

I suspect that the rule you thought you were following regarding any tax agreement isn't what you think it is. I think you were supposed to pay the taxes at the time, and get it back when you left the country at the end of the two years. I thought I read recently that tax agreements like this were no longer in force.

Check your tax treaty. I doubt it says you become liable for back years if you stay here over two years. More likely, it says the first two years are exempt from Thai taxation, even if you stay longer.
