Hi just wondering if anyone can help me :o I will shortly be getting married to my thai girlfriend in bangkok than we will be applying for a Uk Spouse visa. I met my thai girlfriend when I was working as a pilot for AirAsia in malaysia and we have been together for over one year, we also lived together for around two months in malaysia ( but we sub letted a room of one of my mates, so no actual bills!). I am 23 and she is 25 we talk every day on the phone and have the bills to show it, we also have pics of different places we went together. I moved back to the UK in April05, as I got a much better pay deal with a UK airline and currently take home £3000 after tax per month and I am currently renting a 2 bedroom apartment and can supply bank statements and payslips to show this. Can anyone tell me what to submit with our application and our chances of success, as I want to make sure we get it right this time, as we have already been refused a tourist visa because they didnt believe she would return to thailand!

You should support your wife's application with:-

1. Your payslips for the last 3-4 months;

2. Your bank statements for the last 6 months;

3. A copy of your passport;

4. The original marriage certificate and a copy translated into English;

5. Proof of your proposed accommodation (rental contract)

6. Evidence of your relationship (photos, e-mails, letters, phone bills, greetings cards etc)

It's difficult to say whether the visa will be granted or not, but the length of your relationship is in your favour. It would appear that your wife satisfies the main provisions of the immigration rules and that she will just need to persuade the visa officer of her intention to live with you permanently. The visit visa refusal may be a factor depending upon why it was refused.

Well she was refused the visit visa as they said she couldnt demonstrate a good enough reason that she would return to thailand :o We didnt really make a point of it in that application but she does own her house in bangkok with a mortgage in her aunties name! Will this help us at all in our settlement visa at all?

She owns a house in her Aunts name? Not surprising that they didn't take it into consideration with her vv application.

However, this is irrelevant for a settlement visa application as 'Reason to Return' is obviously not a factor.

If a previous vv refusal was detrimental to a settlement application, most of the Thai wives, husbands and partners of Brits now in the UK wouldn't be here!
