Starting New Business/company Questions

Featured Replies

In the total of Google search it does become a bit confusing, so let me you ask some questions.

I am thinking about opening an internet/webdesign related business.

I could probably do some of it in the background, but to really be successful I need it 100% legal. (before anybody gives replies like that)

Can I just run it from my home or do I need a real business location (shophouse), for Thai law wise?

How and where do I go to register a new business/company and what costs, should I think about (lawyer/application/ .....) ?

Since I already live in Thailand, how do I get the easiest way a B visa, needed for business application and work permit?

I am currently on an ED-visa (learning Thai)

What is the setup?

It seems (Google search) I can not be the sole owner (no financial investment), but need a Thai as major partner (on paper)?

What are any yearly returning costs?

Anything else you think I should know.

Thank you in advance to all and a Happy New Year.

Hi ronthai

Legally, if you are working in Thailand then you do need to set up a company and hire Thai employees. You don't say what nationality you are but if you are American you may want to consider setting up an Amity company which would allow you to hold the majority of shares and retain full control of your company, If you are not American then it is possible to structure the shares in such a way that allow you to still hold control but not have majority shares.

Depending on what structure you go for you will need 2-3 million baht in registered capital and four Thai employees. Once the employees have worked for you for one month you will be able to apply for a work permit. You will need to obtain a non-B visa, which you can do with your company paperwork once it is set up.

It is important to note that all paperwork must be submitted in Thai so it is highly recommended that you use a specialist such as Sunbelt Asia to ensure everything is totally correct and legal. If you are in Bangkok please send me a personal message and we can set up an appointment for a free consultation.
