Guess you have been living here for the past year on your tourist visa ??

If so yes no problem,,, but make sure you go on the day your license expires, they will, or want issue another license before that,,, well that's what they told me

I'm out of the country the day my 1 year licence expires is

It a problem if I apply for the 5 year licence 7 days after expiry.

No, as it (1 year) is required to have expired before applying for the 5 year. 7 days is not an issue.

Officially on tourist visa only temporary (1 year) license. or 5 year non-immigrant visa or extension is required.

Yep this officially is correct. have had a few mates on 5 yr licences but when up for renewal because they only had tourist visa's they went back onto 1 year licence.
