Yes, my name is on the Thai land title, i.e. Title VII Thai Law

USUFRUCT

Basically life time use of property. It cost 50THB at the government office.

See attached translation of Thai law. On title Sitthigapgintalordsheevit i.e. Usufruct.

Hi bob, can this be done at the same time when registering the chanote in my girlfriends name,at the land office-or is it better to wait a while then try for the usufruct-as a matter of interest which land office were you at ? i was unlucky went to the cha am land office on the 19th may to register the chanote under company setup and was told i was the first to be refused under new setup !

Please, please don't let there be a rush for usufructs, instead of Company Purchases. Like going from the frying pan into the fire. :o

Put it this way. Would you establish a title you, your lawyer and the Land Office don't understand? Oh, I forgot, people have when making Company Purchases. :D

It was done the same time the land title was transferred into my wife's name at the office in Chonburi. I consulted a lawyer first, who gave me the translation from Thai law into English.

Cheers for the reply bob-can you tell me what is actually needed at the land office for setting up a usufruct on the property(ie-any paperwork) as this may be the answer to my short term problem ! I have allready bought the property with the bank holding the chanote (as i bought it from them),but now unable to go the company route need to sort out before i go back to uk in 4 weeks-cheers

You still need a Thai landowner before you register a usufruct! In many cases, incorrectly, the Land Office will only register on a wife's chanote. :o

Cheers for the info-i take it then that i canot dothis under my girlfriends name ? Maybe i will have to go the 30 year lease route.

Just a quicky dragonman in my company i have 49% the girlfriend 51% (minus 5 shares owned by lawyer and asociates) if my company was to be checked by cha am land office how do you think i would fare-(registered capital only 1million -rundown townhouse bought ) or maybe i should of waited till married ! cheers

You can by law register a usufruct on the chanote if the land is in the name of any Thai National. Your girlfriend would have to own the land, and you would have the right of use for, I say 30 years, some people, going to the letter of the Civil Code, believe life. Don't rely on it.

Various Land Offices, because in general they are pretty ignorant of the Law, place restrictions such as: Only in wife's name: must be inserted at time of purchase:etc.

If you go for a life usufruct you cannot sell, or leave the usufruct to anyone on death. It expires with you. A reason why in France the Law states "natural death" as there were a number of strange suicides. :o
