head starting to spin in circles so hope you can bring me back on track.

a little bit of history. I am married to Thai wife with a seven year old daughter borne in Thailand, I have just received my British passport after letting it lapse for 30yrs as emigrated to Oz. Now have been living in Thailand for five years and married for four years.

i need to go back to the U.K to look after my mother as she is in her later years and I am approaching them fast being 61yrs. and still working fly in out.

I have made an appointment on 13th Oct. to submit all the paper work for my daughter to hopefully get a British passport.

We will be staying at my mothers house which she owns.

Wife booked into Vantage English Test and prep classes. Will complete T.B Check at same time.

Also just been going through on line BETA visa application for my wife for "Apply to join family living permanently in the U.K" ie. Settlement WIFE. I cannot find any idiots guide to help me fill it in and there are a couple points i would liked clarified.

There is a section in there that comes under "sponsor", which I presume is me. But further down the application there is a section that asks: what is the relationship of sponsor to you. As its a drop down box you are restricted to their options and there is none mentioning husband or wife but many other relationships ie. uncle , cousin ect. I just entered the option of "other relative". it seems strange that there is not a section for myself, if I'm correct.

What I would like to Know is.

1. does my wife need a sponsor as she has the required funds in her bank account in Thai bank 18600 x 5 UKP.

2. have we got the correct visa for all of us to go and live in the U.K when myself and daughter both have British passports.

3. Do I have the correct visa application.

You might need to do a bit more research before you submit the application. Your wife is applying for a settlement visa, and you are the sponsor. She must meet certain financial requirements before a visa is issued. Basically, that is you ( as the sponsor) must have an annual income of at least 18,600 GBP or, you, your wife, or both of you jointly must have savings of minimum 62,500 GBP.

You do say that your wife has savings, but I don't understand how much ( she has the required funds in her bank account in Thai bank 18600 x 5 UKP )

There are other ways to meet the financial requirement, but these are the most common.

You have got the correct form; it is strange that spouse is not one of the options!

Sponsor in this sense is not the financial sponsor; it is the person the applicant is moving to the UK to live with; you.

If meeting the financial requirement through cash savings, then this money can be in the sponsor's name, the applicant's or both jointly. Therefore she can use her money to do so. Note the minimum amount required is £62,500 for the initial visa and must have been in her possession and full control for at least the 6 months prior to the application. As British citizens, you and your daughter obviously do not need visas to enter or live in the UK; but your wife does.

thanks for the reply`s.

I will amend the application form as Sponsor to being my mother she has already written a consent letter explaining we are welcome to live under her roof and will not be a financial problem to her and supplied ownership of her house and we have photos of previous visits spent there along with other documents.

Looking on the application form once again under the section of relationship of sponsor it also does not have a drop down for mother-in-law or father-in-law so will just place mother and fill the rest in around my mother as sponsor

Also with have the savings in long term accounts in my wife name in Bangkok bank to cover the amount.

thanks and im sure there will be other questions to come as the more I read the less confident I am that I am 100% correct. and with all the time delays I donot want to resubmit.

You mother is not the sponsor! You are!

There is no UK settlement category for living with mother in law!

Although it may come under 'Adult dependent' but the requirements for that are much stricter, your wife would have to show that she is totally financially dependent upon your mother, which is obviously not the case.

This may be a problem as the funds are supposed to be instant access NOT notice accounts. I would advise you to check this.

Long term accounts are acceptable, as long as the money can be withdrawn instantly, even if it means a loss of interest or other penalty.
