BANGKOK: -- A policeman being probed over his claim to land in Trang's Sikao district says he will lodge a complaint at the Administrative Court today after the Hat Chao Mai National Park ordered him to stop construction of an entrance to the property.

Park head Manoch Wongsurirat, accompanied by soldiers, yesterday told Lt-Colonel Sathit Chansorn to halt the construction pending an investigation into whether his claim to have continuously used the land and his application for land ownership was legitimate.

Sathit insisted he had not done anything wrong.

Well, I'd look for a) FMV fair market value and B) proof of actual payment with subesequent spending of the monies by the seller. Not just a one-off transaction and a cash withdrawal an hour later of the full amount.

What makes this a lucratyive deal?

He's claiming it's his through historical use. A lot of land has been grabbed this way.

Yeah, and did some of the top military brass submit a case to avoid to check their assets and make them public?

on old documents not so easy. Someone just issued an illegal chanote 30 years ago.....what is than? Is it chanote or is it invalid? Specially when the land was already sold several times and the last buyer could not know that the document was wrongly issued.

At least the legitimacy of his ownership has to be proven and that is a start, regardless of the outcome!

He claims to have "continuously used the land" which suggests that the land had been abandoned by it's owner which in Thailand is a perfectly legitimate method of aquiring ownership after a number of years, without having to buy the land.

Well, he could be mistaken in thinking he has.

The head of the Hat Chao Mai national park certainly seems to believe this is the case.

Not that easy here...if you have continuously been using a piece of land for over 10 years and no-one has told you to get off that piece of land, you can claim that piece of land as your land. Better if you fence it off for that 10 years... In Cambodia you can fence a piece of land and if no-one else claims that land in only 2 years... that land is yours.. Welcome to the land of free land. w00t.gif

Not that easy here...if you have continuously been using a piece of land for over 10 years and no-one has told you to get off that piece of land, you can claim that piece of land as your land. Better if you fence it off for that 10 years... In Cambodia you can fence a piece of land and if no-one else claims that land in only 2 years... that land is yours.. I get the idea the land is part of the National Park. He is suggesting that he has been using the land for some time, therefore it's his right to keep it.

This is a similar situation to the National Park near Korat a couple of years ago, where people built resorts. They were told to pull the buildings down.
