Hi there I hope you can help me and any advice would be really appreciated.

Basically my wife is in the UK from Thailand on a 33 month settlement visa that expires next year she's already passed the B1 English exam and is in the process of taking the life in the UK exam the requirements needed for ILR because that was the route I thought we could take.

We have just had a baby and getting everything sorted has been put on the backburner for a while for obvious reasons but I've just been looking on the gov.uk website and it states:

Eligibility

You need to have been living in the UK with a ‘partner of a settled person’ visa for:

  • 2 years if you applied for your visa before 9 July 2012
  • 5 years or 10 years if you applied for your visa on or after 9 July 2012

Now we applied after the 9th of July 2012 and it seems she does not meet the required time limit to apply for ILR.

So if you could advise me what my options are and am I reading it correctly that my only option is to apply for FLR and then apply for ILR when the correct time has been spent in the UK.

My advice to you both would be to focus on your wife passing the LitUK test, for which you've stated she is in the process of undertaking. Get that bolted down and then you're free to concentrate on the seasonable milestones.
