I'm here on a multiple entry Non-immigrant B visa. Have a work permit. Visa expires on Dec 16.

 

My HR department is somewhat clueless. They were supposed to renew the visa as per the last 8 years in a row, but now they realised that due to our office changing locations and the holiday on Monday, there is not enough time.

 

So the questions are:

1. Can the visa be extended for even a week at immigration or are non-immigration B visas not eligible for extensions?

 

2. If I fly to a neighboring country on say Dec 13 and return on Dec 14, will I get 90 more days so that HR has time to then go and take care of the renewal?

 

Thank you for any suggestions! A little unbelievable that I have to ask on the forum rather than at my HR, but I guess I've been here long enough to know that it's not so unbelievable after all...

Do you have a multiple entry non-b visa issued by a embassy or consulate or a one year extension of stay issued by immigration?

If you have a multiple entry non-b visa you can do an entry on or before the enter before date on it and get a new 90 day entry.

The only extension you could get is 7 days to leave the country.

Thanks for the reply. Sorry, it's a one year extension of stay issued by immigration. So that means I will have to leave the country and reapply for non-im B and work permit and all that fun correct?

Unless that can get your work permit and new extension by the 16th you will need to get a single entry non-b visa.

Immigration might put your extension application under consideration if the company was able to apply for the work permit extension and get a receipt for it to show.

In order to apply for the non-b visa at a nearby embassy or consulate the company will need to apply for your work permit and obtain a work permit application approval letter to get it.

Ok thanks much for clearing it up. I was under the wrong impression that I could just fly out and return before expiry date to get another 90 days, but understood that's only on a non-im B issued by consulate or embassy, not on extension of stay.
