Kingsgate ponders civil lawsuit against Thai government to seek compensation

PHICHIT: -- Australian mining company Kingsgate is considering suing the Thai government seeking compensation for the decision to shut down the gold-mining operations of its affiliated Thai company, Akara Resources, in Phichit province.

 

Kingsgate chairman Ross Smyth-Kirk was quoted in ABC News website as saying that the Thai government earlier suspended the gold-mining operations at Chatree mine in Phichit and, last week, invoked Section 44 of the interim constitution to shut down the company’s operations by the end of this month.

 

He said that the government’s latest move was unreasonable and could drive away foreign investors from Thailand. Citing the government’s claim that the company’s operations have caused division among the local people and threatened health of people around the mine to justify the closure of the operations, he said that the government could not present any scientific evidences to prove the claim.

 

The Kingsgate chairman noted that the Thai government should not have closed down a business which is performing satisfactorily without proper reasoning.

Then Thailand sue Kingsgate for poisoning the people with the chemicals used in the mining process and for polluting Thailand with the same chemicals...

U have proof of that,  because if you have, you are the only one, not one protester has reported sick not one has been sent to hospital and even the Thai medical and mines departments along with outside orgs , cannot find any pollution , the problem started when Kingsgate handed over control to the Thai controlled  company Ankara, till then not a word, go figure son.

Is Kingsgate a contractual party with the Thai govt, or is Ankara Resources? If Ankara did wrong, would Kingsgate be held liable?

So the article clearly state that Kingsgate want to sue the Thai government for closing down the mine and you are saying that its not owned/controlled by Kingsgate when I say that then Thai government will counter sue Kingsgate for pollution... I don't understand how your mind is wired!!!
BTW. I don't know about the pollutions from this mine but you can typical find mercury, sulfuric acid and other things polluting the air, ground and water close to gold mines!

I think you'll find upon a little research, that subject has been thoroughly investigated.....hence the company' ability to continue mining

Some hiso Thai family will soon own and be operating the mine. Infrastructure and trained

employees already in place. :coffee1:

A Kingsgate lawsuit would be a dead-end as Article 44 has the legal effect of a constitutional act under the 2015 Provisional Constitution and cannot be challenged by the courts.

 

But a Kingsgate lawsuit might be seen as causing national conflict/confusion and give the government cause to countersue for defamation. In such a defamation lawsuit it would be irrelevant as to whether the public accusations against Kingsgate mining are incorrect.

Anyone living or investing in Thailand should never lose sight that a government as exists at present can do absolutely anything it wants to without being challenged. Kingsgate are pissing in the wind.

Good luck. Their country their rules and article 44 is the big stick in the arsenal. You could try international courts but China has showed that their decisions mean diddly squat.

Ah yes the key words. Just fold your cards according to Harry Dent gold will fall to $750 an ounce and not be profitable. When I look at how gold has reacted to Brexit, Trumps election, and the French vote I think Harry has a point. The fix is in. The Fed wants you to hold paper not gold. Don't fight the Fed they can paper you over time and again.

I'm not a big fan of mining, but the world used to revolve around facts.  If you don't have facts, don't waste your time speculating...

This is what amaze me companies all know too well dealing with a Junta government is a risky business the military and it's general not business people will take away your rights if you think you have any.

Yep. Exactly. In another article here on TV, a Thai national made a takeover bid of $9 million (not sure AUD or USD) recently. Kingsgate has stuck to their guns but knows the govt trying to shaft them. 

In any case, as another poster pointed out they may have no legal recourse under the current regime. Basically, Kingsgate being forced into a fire sale (at 10cents on the dollar).  Once the operation is in Thai hands, the mining ban will be miraculously lifted and mining will continue. In the original article (which I am still trying to find) the potential buyer is even quoted as saying he has influence with the govt to reverse the ban. In other words, it is pretty clear its the Thai way or the highway for Kingsgate. Whatever transpires, Kingsgate is out, Thai oligarchs in.

No they built one next door which can be operated more cheaply.
