Since im travelling soon to Spain, with my non EU  Wife, we applied for a N.I.E. Number at the Spanish Embassy in advance since she is intitled as Spouse from EU Citizen .

My question  is, once we arrived in Spain , after she  has registered for the RESIDENCIA  with said NIE Number, is she already allowed to extend her stay based on the Schengen Visa ( max. 90 Days) , as EU Relative ?

In theorie she has the right to stay in the EU , based on the Marriage aniway.

How will this be handled from the Spanish authorities?

Thanks in advance.

After you applied for the Certificado de registro de ciudadano de la Unión via form EX-18  your wife apply for a Tarjeta de residencia de familiar de ciudadano de la Unión via form EX-19.
The Tarjeta de residencia for 5 years is the residence card.
The NIE can also be applied via EX-18 and EX-19.

Can this be done everything trough the Embassy in Bangkok or only the NIE processing ?

I found that form EX-15 is provided online but nothing else.

http://www.exteriores.gob.es/Embajadas/BANGKOK/es/InformacionParaExtranjeros/Paginas/NIE.aspx

Does she have to apply for the  Tarjeta de residencia de familiar de ciudadano de la Unión   in Spain directly ,once she stay there or possible in advance as well?

Thanks a lot.

Great .

So far i understand, once the application is made, the receipt is valid as proof to stay legally on spanish territory, until the  Tarjeta de residencia de familiar de ciudadano de la Unión is issued .

Right and if you have a thai marriage certificate it is maybe a good idea to get a legislation for Spain from the spanish embassy in BKK.

So far i understood the Family Book will be fine, in my case issued from Italian Embassy.

But, yes, possibly they will ask for this as well.

Now, furthermore im looking into legalization process for official documents, and not sure how to handle . ( I got a Pension from Switzerland and since it isnt EU maybe they will ask for this additionally as proof of financial situation.)

Anyway, all seems quite transparent on their websites.

The Spanish must have invented bureaucracy...

Though, what i recently wrote on another Forum related to Spain, they stopped issue the Tarjeta de Residencia, only the NIE which replaces the Card.

(Even they still advertise it on their official websites.)

Any idea???

The NIE is only the tax number.
I don't think your wife  can cross the schengen border only with a tax number.

Issuing a residence card is mandantory due to the eu directive for family members.

You get me wrong.

Of course we get a Schengen Visa in advance.

Im refering to NIE replacing the Tarjeta de Residencia (of EU Citizen.)

Per example in my case, i just received the CERTIFICADO de Registro de Ciudadano de EU , which is already stating my permanent residential status.

Its a green-blue card, paper like and plastified and valid a lifetime.

Nonetheless we still have to register at the local branch, once in Spain, for the Spouse  of EU Citizen to become Residential status as well, based on my current knowledge.

And , so far i understand the NIF is the Tax number , based on the NIE, which is not the same and have to be applied for seperatly.

The spaniards have the duty to issue a residence card for none eu family members for a stay longer than 3 month.
NIE and NIF is the same for foreigners.

As far as I know EU citizen can get a NIE in form of a ID-card.

Can I apply for the NIE (as Italian citizen currently residing in Thailand) in Bangkok prior to my move to Spain?

I do have a valid apartment rental contract and already enroll my kids to a local school if that can help.
