Koh Tao Appeal...What's happening?

Featured Replies

It's been a few months since I have seen any update on the appeal for Zaw Lin and Wai Phyo.  Does anyone have any updates on this case?

Cheers!

Documentary raises new questions about Koh Tao murder, Myanmar migrants from The Myanmar Times May 17th

Thanks for posting khunPer, from the article:

Some migrant rights advocates have argued that there may have been discrepancies in the case's evidence and CCTV records as well as potential discrimination on the part of the Thai policemen and judge.
Moe Wai, a member of the Special Investigations committee and organiser for Myanmar migrants in Thailand believed the judges may have had implicit bias when deciding the sentencing.
"The judge may decide using his personal opinions but it is best to solve this with professional standards. We, ordinary people, cannot become involved nor have a sway in the system of law and order."

If you remove the word 'may' and the phrase 'may have' from the article then you will find that it sums the situation up precisely.

Burmese government have been involved from the beginning, along with the monks of Ma ba tha

There are a few scenarios of what has happened.

Defense has submitted appeal on 23/5 and it was accepted

Defense has submitted appeal but court has rejected it.

Defense managed to get another extension.

Defense has abandoned the appeal.

Take your pick.

My understanding is that the appeal was by the judges that sentenced these two in the first place, there was no was they could 'lose face' by admitting the catastrophic errors they made during the trial so now the appeal moves to the next stage.

Article from June 12th...
Koh Tao murder case ‘mishandled,’ says legal team amid last-ditch appeal

A Burmese legal team has submitted to the Lawyers Council of Thailand a document outlining what it says was Thai investigators’ mishandling of evidence in the case of a 2014 double murder on the resort island of Koh Tao that was pinned on two Burmese migrant workers now facing death row.

“The law and criminal affairs experts’ group led by the director-general of the Union Attorney General’s Office, Khin Cho Ohn, submitted a seven-page document of 18 points, which especially highlighted questionable [handling of] DNA evidence, to the Lawyers Council of Thailand on 5 June,” said Aung Myo Thant, a legal adviser at the Burmese Embassy in Bangkok...
