With DOJ's lawsuit challenging the merger between AT&T and Time Warner it might not be smart to do so now.

In a defamation suit against President Trump, how does one separate personal capacity from presidential capacity with regard to public comments? I don't believe it's possible unless President Trump caveat's his public statements as "personal opinions and not as president." Given Trump's ego - hasn't happened and never will happen. Even if Trump were to make such a distinction, a plaintiff probably couldn't move forward on the suit until Trump leaves office (2018, 2020, 2024?).

 

Maybe the best way CNN/Time Warner can challenge Trump on "Fake News" is to demand a public debate (moderated by FOX News? LOL). The most practical way is through promotion of CNN's trustworthiness and holding Trump accountable for his lack of trustworthiness. Whatever CNN is doing, it appears to be working: " Half the public finds CNN more trustworthy than President Trump."
