Hi all

 

Currently trying to navigate the minefield that is obtaining a UK Spouse visa for my wife.

Myself, wife and son will be initially staying with my parents in their 4 bedroom house.

 

We will get a letter of invitation. Council tax. Lease agreement with stated bedrooms. Utility bill and photos to help with the process.

 

My question is; Do we need to action an independent property inspection report ( at more cost and rigmarole ) as my parents house is

part of a Housing association group?

 

We have stayed with my parents twice before, both on 6 month visit visas without the need for a property report.

 

Any feed back greatly appreciated.

Letter of invitation; yes. This should briefly describe the property, i.e. number of rooms,. and who else lives there to show that there is at least one room for the exclusive use of you and your wife and another for your son.

 

Council tax, and photos are not required. 

 

Lease? Not necessary with the application; if the ECO wants to see it, s/he should ask for it.  From Maintenance and accommodation (MAA)

The ECO should consider the basis of the availability and security of tenure of the accommodation. Factors to be taken into account will include:

  • the ownership of the property and/or the duration of a lease
  • whether any lease enables the tenant to sublet to the couple or take them in as lodgers.......

11. MAA11 Adequacy of accommodation

The ECO’s judgement should be based on the evidence from the applicant. If the ECO is not sure of the credibility of the applicant, he / she should ask to see a letter from the owner of the property (which may be a housing authority, housing association, landlord or a building society). This should confirm particulars of tenure and occupation of the dwelling, together with a description of the accommodation and, if rented, a copy of the lease.

The onus is on the applicant to provide confirmation that there is no objection to an additional resident moving into the accommodation.

So, bearing in mind the last sentence, you may want to include a copy of the lease and a letter from your parent's landlord; but I know of many couples in your situation who haven't without any problems.
