Hi wondering if anyone has received a 6month multi entry visa while waiting for partner visa my story is that I have been married for 21 months we got married in Aus  we have a 2 yr old Son who is Aus by descent u wife has had 2x 3months tourist visa and 1x 6mth visa a year apart finished July this year.

im returning in nov to lodge our partner visai have also done all paperwork for another tourist visa as 12mth waiting time is to long apart if only granted 3mths or can we go back to back 600 visas I know she must be out before partner visa is granted but that appears to be on the worse side of 12 mths so surly they don't expect me to be apart from my wife & son for 9 months if the norm is only 3mth visas while waiting ?.

also can I bring her brother here at the same time both on tourist visas

If arriving in Oz on a tourist visa, without the no further stay condition, you can apply onshore for a partner visa. Wife should immediately be granted a bridging visa whilst the application is being processed. Sure can sponsor a tourist visa for wife's brother at same time, though may be a challenge as will have to provide sufficient evidence as to why he will return to Thailand.

Okay thanks for that so wife & son currently in Thailand I was going there on 2 nov with all paperwork to do partner visa and also for a tourist visa so should I lodge the tourist visa only and wait & see if she gets a no further stay cause and lodge paperwork back in Aus  for partner visa?

 

all three previous tourist visas has had the no further stay on them guessing because of the son Being Aussie .

 

also there may be a chance if u only lodge a tourist visa it may get refused as its her 4th visa & second visa this year.

Sorry I am wary of providing a definitive answer as the prior tourist visas all had a no further stay condition. Hopefully someone else can provide guidance for you or arrange an appointment with VFS to receive guidance on the best way forward - from memory personalised service will cost approx 3000 baht.

Simple1 has given you some good advice.

 

The advice remains the same, lodge the tourist visa first.

You might get lucky and not get 8503 but if not, you can then lodge

the spouse visa application anyway.

 

If they're going to refuse the tourist visa because of repeated visits, it's going to be

refused regardless if it's lodged with a spouse application or on it's own.

 

IMO, if your wife has spent January to June this year in Oz, you would be pushing it asking

for another visa in November. If granted it would mean she would've spent close to 9 months

out of 12 in Australia which hardly makes her a tourist.

Thanks but I will lodge partner visa in nov I  will go back in the new year and lodge tourist visa they from what I have read will give 3months without hassle once u have lodged. 

Its such crap that u have been together 5 yrs married in Aus for 2 yrs have a son together lodge a genuine partner visa which is based on proving your in a committed relationship but then they say u can’t be together for the best part of 9mths of the year while u wait!! They should give a bridging visa for everyone who pays the $7k partner visa

OP have you factual knowledge on why your wife was given no further stay condition on prior tourist visas, as you were married in Australia and have a child together; to me seems a bit odd. Recently my step son's girlfriend. Taiwanese,  received a 12 month multi entry visa, without no further stay, even though prior she had received a three year ban (expired) for erroneously overstaying by three months.

No good reason what so ever is what I’m guessing & your story doesn’t surprise me one little bit after 10 yrs going to Thailand these totally random decisions like your stepson’s gf vs my wife with no overstays or any history getting no further stays on her past visas is the reason we get so agitated with the Thai system which is none.

anyway I will just battle it alone lodge our partner visa wait 12 months bring my family back for 3months in between and suck it up for the other 8 or so while walking to the supermarket here in Melbourne looking at the 1000s of Asians walking past me wondering have they all gone through this process.

lodge you partner visa and then lodge the tourist visa. They know she won't overstay and ruin the chance of a successful partner visa grant by overstaying. They can only refuse it, but why would they? your married and have applied for a partner visa like you should if your married. Best of luck
