No, they could not.  It is not illegal to travel abroad with a child you have shared custody over. 

 

It only becomes illegal if another guardian, also with shared custody, reports to the police that she does not consent to you traveling abroad with your child.

'Guess the folks at BKK didn't know that. Either way, it seems that Mr. Felton figured that they could travel to BKK from SakNak and exit the country before anyone at BKK became aware anything was amiss even though it would be obvious, looking at the young boy's UK passport, that he entered Thailand in the company of someone other than his Father.
