Correct and it is not really just because it is business that owns the building, technically second or more homes owned by individuals and rented out are subject to this tax as well, it is only tax free if the owner is resident.

In theory you can then offset the fact it is empty against the tax, so if it is empty for a say 6 months of the 12, the tax owed should be 50% of the 12.5% yearly rental value.

This is the so called house tax. I think it is calculated on the size of the house (and the swimming pool) according to the building permit.

I have to pay this tax every year in February/March to the Municipality Office here in Samui. The land and house are in our company's name and I am living in it. Until about 5 or 6 years ago, my accountant was responsible for paying this tax, but as it seems, he some times forgot to pay it and I had to pay some back payments. Since then I do the payments myself and no more problems.
