Problem with condo purchase - funds already in Thailand!!

Wive can not borrow against property without husbands consent.

If a marriage is not recognized then the ones concerned are extremely dumb. The 'entire bureaucratic gambit' consists of a visit to the Amphur and get the papers signed with a witness.

 

btw if you don't trust your wife, she should have stayed a girlfriend.

Are you sure? The property title deed has just her name on it. A loan shark will do a Kai F...  all day long and you will get f..... when the loan is not paid back. 

 

A lease is essential to avoid having your house mortgaged.

Maybe stay in the realm of legal consequences otherwise she might poison him, or push him from the balcony, or get her 'brother'/husband to teach him a lesson. Shall i  go on?

 

If she goes to a bank and tried to get a mortgage, the husband have to sign. If not then the bank is at fault and can be sued.

The first question is 'Are you married?' (Kasikorn, Krung Thai, KrungSri, Bangkok bank)

I know because we did get a mortgage (Krungsri) on one of our condo's.

Which is very true, my neighbor bought a nice condo after winning the Thai Lottery, he had to transfer his money to France, then back into Thailand again, marked "For Condo Purchase"  -  12 Million baht worth, cost him about 80,000 baht in exchange and transfer fees.

Sue a bank in Thailand??  How long have you lived here??  You have a better chance of winning the lottery.

I 'm not sure, but he has a fabrication company in Lat Prabang, so I suspect his lawyers helped him out, all I know is he couldn't buy the condo with the money until it was transferred back into Thailand

Send the money back now.  Good rates going out of Thailand.  Wait for the rates to improve a bit coming back in and send back.  you will reduce your loss by right timing.  Also make sure you send it back in your home countries currency.  Obviously Thai bank wants to do the exchange rate  if you have it come in as Thai baht it won't be acceptable to buy condo.

Transferring away from Thailand can be done with online angencies offering better than banks, but coming back in it must be through the rip off banks.

Long enough to know that you do have rights and can win court cases in Thailand as a foreigner.

Unless you are the 'mai pen rai' sort of guy and just accepts everything.
