Can an Overstayer Company Director legally sign company condo transfer

Just a quick question and I haven't encountered this yet but as they say forewarned is forearmed. If an overstayer wants to sign as the director a contract to transfer a condo his Thai company owns to go to chanote can he legally do this whilst in Thailand?

The land office dont do any checks on immigration status.
