I was parked in a friends drive last night, one of his friends turned up and reversed at speed into the rear of my car, he said sorry, and refused to even look at the damage, by this time i had lost the plot with him, he kept offering to pay money for the repairs, the car is fairly new so i was IMO understandably very peed off, i don't want it repaired by a local and want it repaired at a capable dealership which is a 4 hr drive. i have contacted him today and asked for his insurance detail's, he only wants to see a Quote and pay cash. what would you do ? sensible answers please.

It would seem to indicate he either doesn't have a valid insurance or perhaps a valid licence and doesn't want authorities involved. (Possibly).

 

Take the quote, get the cash and get it done, if the cash isn't forthcoming, you know what comes next.

He may be uninsured. Or he has reached a limit of claims he can make on his insurance, and will be uninsurable if he makes one more claim.

As Charlie H said, get the quote, show it to him and take the cash.

What would I do? Get the quote and get the cash... Its not that hard to deal with is it ?

 

It was an accident, he's willing to pay for the damage. At this stage I'm not sure what the issue is - repairing an accident is never going to be convenient.

If you have it taken care of by the insurers they will usually decide where they want the repair done, you won't necessarily have the option to demand that a dealer of your choice repairs it. 

 

Many dealers sub-contract some body repairs to local body shops anyway and would you really be in a position to know anything about the comparative expertise of a dealer's body repairers vs good locals?  

 

He's admitted responsibility, agreed to pay, so why not get the quote from your favourite dealer, show it to him and get the cash?

If he's willing to pay not a bad thing. My car once rearend scratched by young couple in a fishy pickup, also have police nearby as witness. I asked 2500, they haggled to 1500, done... Back home some spray paint clear coat and sanding, good as new! Then spent 1500 on meal. 

 

... ... One year later while checking my car, found brake light never worked due to previous owner's wiring fault, dang... so maybe not their fault? (facepalm)

Yep i do. i also need expenses for hotel,fuel, and hire car. up im !

The issue is i will need to travel to another province and stay hotel, have no transport  . i will only allow the dealership to work on it not some local cowboy. it was not, just an accident it was careless driving buy a <deleted> head. but thanks for your input.

Thanks to all, i will phone dealer tomorrow get the price of a new plastic bumper plus expensive s, i have cooled down now, it will cost him more than insurance, it is only the dealers that really know how to fix it and it is still under warranty.

Not to be to rude, but you need to pull you head in a little.

 

If this was going through insurance, you would not be paid or compensated for hotel or fuel or anything else.

 

Your wishes of this or that have zero relevance. If you wish to take it to another province, then you pay for all related expense, he does not have to, nor will anyone make him.

 

You can continue being a dick and get nothing or you can come to your senses and deal with it as a grown up man. and yes you can respond with some nonsense and some insults, only facts will remain facts and no one is going to pay for hotels, fuel, food or anything else.

 

Still do not like it? take him to court, spend another 50 000-100 000 on legal fees to be told the very same thing by the judge

Yeah if it's 5000 baht tell body-shop to write a quote for 10,000 baht.

Compensation IMO. 

When someone says 'shut up and take my money' - take the money....

Every accident is careless driving by one party or both - accidents happen. 

 

The other party doesn't seem 'that much of a <deleted> head' if he's offering to take responsibility and pay up. 

 

On the other hand you seem to be throwing road blocks in the way potentially alienating the other party and making life a little more difficult for yourself in the process. 

 

 

You can - get the car fixed on your insurance and ask the Op for Costs of a spare rental in the meantime. 

You don't need to travel anywhere, the dealership can take care of the repairs through your insurance. They can come and collect the car on a flatbed lorry.

Good point as the OP is acting like a Thai with his demands.

Update; I got a quote and now he wants his insurance to pay, Guess what, he has gone back to his country and wont return till end of JAN i still don't have any of his insurance details and he is unreachable.

I'd just call my insurance company and let them deal with it, my insurance company does not pay for fuel/rental car/hotels.

 

give them as much details as you can, His name/phone number/car licence plate number etc etc etc.

Yep through sleuth i now have that and rang the insurance, i was told to go to the police and make a report, which i duly did (2.5 hrs and 20 baht    555) . the assessor came yesterday gave him  a copy, and then had to take him to see the other vehicle. Now just wait till he comes back and get him to sign a form he gave me. I know i wont get any out of pocket expenses, but at the time, i was so angry with him for reasons already posted ie i will pay cash repeated over and over. Oh yer his car is an ESCAPE   LOL. in the meantime i have to drive with the rear hatch rattling away and door open light on. Just to add the Quote i forwarded to him was around 10,000 baht. going by some unexpected photos the assessor made under the bonnet at the top of the shockers i am guessing his Quote will be more,.

Not yet but believe me i will. all he had to do was give me his details but he refused and i did not want the police involved, but there is time limit on making claims. He couldn't put his money where his mouth is !

Under bonnet photo's was maybe the VIN number.
