What a strange thing to ask.

 

The 820 is a temporary visa until she obtains a 801 visa which is permanent residence.

 

I don't know what 5 years has to do with anything.

There are 3 definite reasons she can (criminal in nature)

But she needs to have the Sponsor while her PR (which you already paid for) to remain in country

So in that case she would have to notify Immi & apply for a different Visa while her PR is being processed 

 

A friend of mine had a break up whilst doing this process (not sure of full story ) but he just went along as normal since kids were involved
