Does extension of stay cancellation need to take place at same office as provided it and does work permit cancellation need to preceed it?

Featured Replies

Thanks a lot in advance for knowledgeable input regarding following and for reading this!

I will receive a termination letter on 26 April 2021 that my employer agrees to my retirement and dismissal. Current work permit expires 29 April 2021 and the non-RS extension of stay in my passport expires 1 May 2021. Due to internal workings of our organization, the dismissal letter can only be released on 26 April. Both work permit and annual immigration extensions were issued in Bangkok where work is located.

I will proceed to retire in Prachuab Khiri Khan and Huahin immigration has already kindly confirmed that I'm eligible for a retirement based extension of stay based on current non-immigrant visa. In order to not travel back and forth too much in short time span, I was hoping to have Huahin immigration process the cancellation of current work based extension of stay at the same time that I submit the application for retirement based extension of stay. I have four questions in this context:

1. Do I need to cancel my current work based extension of stay in Bangkok, where it was issued, or can it be done in Huahin with my employer's termination letter?

2. Does work permit cancellation need to preceed extension of stay cancellation and do I need a receipt from labor department to this effect? This was not so in the past, but some threads suggest this to be the case now.

3. Can both or either be done in advance? I.e. I receive letter on 26 April with dismissal per 29 April; I then proceed to get work permit cancelled by Dept. of labor on 26th or 27th but effective on 29th and go to Huahin on 28th for cancellation of current extension per 29th as well and for filing of application for retirement based extension of stay.

4. In 'worst case scenario' in which both work permit and extension of stay need to be cancelled on same day in Bangkok and I cannot make it on time to Huahin any more that day, can I be sure to get a 7 days extension of stay in Bangkok and will I still be able to apply for retirement based extension of stay in Huahin (as visa has not changed) within those 7 days? I want to proceed in Huahin because I read about variability in being approved for retirement extension in Bangkok among officers and would rather not take that risk. Some apparently agree to provide with any non-immigrant visa (as the regulations seem to stipulate) while some insist one leaves the country to pursue a non-O visa.

Thank you very much again for any knowledgeable guidance!

1. It needs to be canceled at the office that issued it.

2. Some office will want proof the work permit has been canceled.

3. The work permit can done before the extension cancelation.

4. Most immigration offices would allow you do the extension cancelation before your termination date and post date the cancellation to the date shown on the termination letter. During that time you could apply for the extension based upon retirement in Hua HIn.

There is not 7 day extension you can get. Immigration will only do a stamp after paying the 1900 baht fee that gives you 7 days to leave the country after the extension is denied.
