My son and I have been back in the UK for about 6 months now. We returned so that our son could study at Primary school here. My wife and I agreed to let my son and I settle down here in the UK before she applied for a visa to come over and join us.

My farang friends who are still in Thailand reckon that it will not be that difficult for her to get a visa, because her son is over here, and that we have the documents to show when applying, son's original British birth certificate, our Thai marriage certificate, etc.

However, I do not agree, because of the visa requirement that states: The sponsor must not be in receipt of Public Funds. I have a part time job here, but am unable to take up a full time job due to having to look after our son when he is not at school. so, I still receive some Income Support, minus the part time money I receive, and Housing Benefit.

What do you think her chances of getting a visa will be? And, what type of visa should she apply for?

Have you enquired of your local Citizens Advice Bureau?. They will be able to put you in touch with their department that specialises in advising/helping people prepare their application to the Entry Clearance Officer system
