We'll see what comes up from the investigation. The law specifies: "knowingly removes such documents or materials without authority and with the intent to retain such documents or materials". I doubt having a few classified documents scattered here and there can be used to accuse him of such intent!

The number found in the Biden house and office is a small fraction of the number found in Mar-a-Lago.  Plus the Biden team is responding in accordance with the law upon discovery, while the Trump team broke the law.

Hundreds of classified documents were being held by Trump, and he resisted returning them to the point that they had to be recovered using a search warrant.

"Unlawful" is one thing, "criminal" is another. Unless it can be proved that Biden willfully ignored the law, no crime has been committed. If there is a record of him retaining those records despite the advice of legal counsel, that would be criminal. If there is a record of him denying to the Justice Dept investigators that he had possession of them, when in fact he knew that he did, that would also be criminal.

Not an excuse, a fact which may be relevant as the law specifies that intent is a necessary condition.

I see what you are saying. So, what is the "magic number" of classified documents someone without authority can be possessing when the situation changes from a "nothing there there" to the crime of the century? 27? 100? 200?

 Now most of us here, self included are not lawyers, but this whole claim about it all hinging on a number of documents to determine legality and severity sounds unlikely.

You are correct.  The legality issue is determined by the response taken once the classified is found. 

 

If the classified was misplaced accidentally and is reported and properly secured right away then no law is broken. 

 

If the classified is not properly reported and attempts are made to keep the classified illegally, then obviously the law is broken.

There is also the vast difference between President Biden clearly telling the FBI and the DoJ to go ahead and search for more, and ex-president Trump and his lawyers denying all knowledge of ANY documents for months and making the DoJ get a search warrant, after nearly 2 years, which was then dealt with by the FBI.

 

If you cannot see the difference then I pity you.
