In my country you must have a liability insurance before you can use your car. So I believe his insurance company would pay for third parts damage and in cases like this they might make recourse to the driver since he was under the influence and not allowed to drive.
If the driver did not have a liability insurance it will be a more serious case for the court. He might loose whatever he has to pay for the damages.
