BANGKOK (NNT) - The Election Commission (EC) has extended its investigation into Pita Limjaroenrat, the prime ministerial candidate and leader of the Move Forward Party, concerning his eligibility to run in elections.

The move follows accusations that Pita knowingly registered to run for a parliamentary seat despite being ineligible under Article 151 of the MP Election Act due to his holdings of shares in the now-defunct iTV media company.

According to EC secretary-general Sawang Boonmee, the probe has been extended for an additional 15 days from July 4.

The EC has also forwarded information regarding Move Forward’s policy advocating for the possibility of amending and abolishing the criminal code of Section 112 to the Attorney General. The EC is requesting clarity on whether the policy, which has been a point of contention, is in violation of any legal regulations or norms.

However, the registrar of political parties did not previously accept a petition filed against Move Forward over this issue, stating that there was insufficient evidence or information to suggest any actions which would constitute a threat to the monarchy - a fundamental institution under the democratic system. Despite this, the EC has ordered further investigation into whether the accused actions may infringe upon any other legal provisions.

The EC’s decision was in response to the Constitutional Court’s order for the Attorney General to clarify its position on this matter, in line with Article 49 of the Constitution, which deals with threats to the royal institution.

Unbelievable that a law as section 112 can not be amended or changed...and that talking about to do is already a reason for disqualifying....Are we still living in Middle Ages??

The law can be changed. When Prayuth instigated the coup and tore up the constitution, there was a brief period where it didn't exist. Some diehard 112'ers here don't seem to understand that ALL laws can be changed.

The first rule about Monarchy reforms is you do not talk about Monarchy reforms.

Given AG Naree's track record Pita is probably in trouble.

Naree Tantasathien: Thailand’s top lawyer weighing Move Forward, Pita’s future

In November 2022, she approved the prosecution on sedition charges of three key figures of the dissolved Future Forward Party – Thanathorn Juangroongruangkit, Piyabutr Saengkanokkul and Pannika Wanich.

Her decision came after the police rejected the public prosecutors’ push to dismiss the case. The police wanted the trio to be charged with sedition for allegedly inciting political gatherings in October 2020. The case was brought by former yellow-shirt activist Suwit Thongprasert, who previously practiced as a monk under the name Phra Buddha Isara before being defrocked and convicted of detaining two policemen.

It can end in that the Thai people totally don't respect section 112 anymore, and than there is a much bigger problem. It is impossible to prosecute thousands and thousands people for offending section 112. I see now already that several people don't stand still anymore when the national anthem is played at 18.00... It is just a sign...

In fact I suspect there's some pretext to the existence and construct of law in Thailand  says / dictates that new laws can be passed and amendments can be made. Surely just logical.

Then why make an unsubstantiated post?

Or is it just a smokescreen to hide behind?

I imagine he can not only substantiate  the post but understands the potential for danger.

Translation:  We haven't found anything the least credible to disqualify Pita so give us even more time than the weeks and weeks we've already had to see if we can dig something, anything up that might work to disqualify him.  Just pathetic.

Oh how they hate him.

Hope there is a capable successor waiting on the sidelines although it wouldn't surprise me if they found him guilty and along with him most members of Move Forward .

Let the street protests begin .

You could say exactly the same about some parts of the American constitution.

It's a bit of an extended racket.

Generations have been dumbed down.

Sure. As well as the cherished U.S. Bill of Rights, both which are terribly archaic [less enlightening] and never revised to be updated with the times. Remembering that the original authors were of the oligarchical ruling class that fits in just nicely with their contemporary peers.
