I’m in the unusual visa situation of being under 50, my legal Thai wife and I separated a number of years ago very amicably, she lives with her new partner in a condo she owns and I live with our half-Thai son in a condo I own.

 

I cannot get a marriage extension because we don’t live with each other, and aren’t interested in lying and pretending to during an immigration home visit.

 

I cannot get a child extension as I am married to the mother and haven’t been given full legal parental right by a court or amphur. Getting legally divorced and going through the legal process me getting full sole custody also doesn’t really interest us. Immigration won't give extensions based on being a parent without that, as the funds don't need to be seasoned and they see it as a way married aliens could get around needing to season funds if they have a child.

 

To add, my overseas income streams come from a third country not my home country so my embassy doesn’t give income verification.

 

When I turn 50 I will keep 800,000 in a Thai bank account and extend based on retirement.

 

Until then I have a ME Non-Immigrant O from Savannakhet from 2019 based on marriage, which an agent has been extending. It has a note on top of the visa stating the reason is marriage (not child), which agents noted in 2020 when I was looking to extend it based on child, and immigration would only extend it based on marriage.

 

The last extension expires in 3 months time. The agent I’ve used, they provide full funds and all duties, now require the person to be there in person and stay for one night (on the other side of the country) and the price has also increased 30% from 2020, and 20% from last year.

 

Choices:

 

Continue with that agent that does everything with the added expense and travel etc.

 

Go to Savannakhet for around the same price inc 4 border bounces, inconveniences are border bounces and sorting out the transfer for 400k to my account. I would rather it extended based on a Thai child if possible for extensions based on that.

 

Try to get an agent that can sort a marriage extension that doesn’t include home visits.

 

Referring to the latter, I have the time to season the 400k if there are agents that do that.

 

 

How common is it for agents to get marriage extensions with all documents and funds provided, but not include home visits?

 

Does Savannakhet offer ME Non-Immigrant O visas based on a Thai child?

No, they do not offer ME Non O based on a child. I've have tried... but I get told only single entry Visa. Like you I'm under 50 so there are not that many options.

Still married to the mother, don't have full legal custody. It's a no-go without those. Immigration don't do it if married due to not needing to season the funds. Otherwise every married father would do it and not need to season funds.

 

For the next extension it would also require leaving the country and coming back in without the current Non-O based on marriage.

 

Altogether, not an option.

One agent replied saying it should be okay, that home visits are usually for only the first extension.

 

The location is Chiang Mai, previous extensions were done in 3 different provinces.

 

To be honest, I'm not really looking for should bes or usuallys. I'm looking for will or won't from agents.

 

 

Are CM immigration known for only doing home visits on the first extension?

 

Would the previous 3 extensions being done in 3 different provinces come into play? (house books and ID cards are in this province)
