A LAWSUIT FILED IN THAILAND in pursuit of a party dissolution on sprawling grounds of undermining the country’s rule would be unquestionably lifted by court in other democratic countries, according to a prominent academic.

 

Munin Pongsapan, Thammasat University’s former dean of the Faculty of Law, has remarked the lawsuit recently lodged by the Election Commission for the Constitutional Court to consider dissolving the Move Forward on lese majeste grounds would be effortlessly waived if it was judged by the European Court of Human Rights or the United Kingdom’s Supreme Court or Japan’s Supreme Court, among others in democratic countries.

 

Munin pointed out that Thailand’s principles of law pertaining to dissolution of political parties which, he said, had literally imitated those of a few European countries could possibly be abused, either inadvertently or purposely, to deliver unjust verdicts to defendants.

 

Though the law governing charges of undermining rule mentions similar content as in the law pertaining to a dissolution of a party for such alleged offences, one should be by no means referred to by court in intertwined fashion with the other, according to the former Thammasat dean.

BUT Thailand NOT like other democratic countries....

Thailand however is not a democracy but a totalitarian system that will silence everybody that is against it... The army and cronies will decide how things are going and I am sure that in a few years maybe things will start to change but there will be a lot casualties and than they have to rebuilt the country which normally takes about 35 to 50 years....

Comparing apples and oranges here. Thailand is ruled by the military/elite. The highest courts are miltary plants. The Senate is full of military plants. The EC is military plants. I cannot see a comparison. Everyone knows the charge is spurious but to defend against it MFP must go through a corrupt system designed to maintain the status quo i.e. the power and wealth of the military/elite.

Thailand is hardly a democratic country!

As above, plus such gross misconduct would not allow bs governments to form in the first place. But certain European states have already gone through their really bad and corrupt periods and have hundreds of years of experience. Thailand is unfortunately still generations away from weeding out the wholesale me me me mindset.

The world is changing at an ever increasing pace.

Those who don't educate their populations well, will slide further and further into the mess they already find themselves in.

"The world is changing at an ever increasing pace." Yes, and for the worst. Democratic countries are becoming less democratic which has been very well demonstrated in the last 4 years.

What will happen if MFP and Bhumjaithai Party dissolved new elections ?????

The MPs can join other parties, usually only the executives are banned. 

This time though the court might ban all 44 MPs of MF who proposed the motion to reform 112.

I'm sure MF have a party for their MPs to go to 

If Bhumjaithai are dissolved, most would go back to their old home, Pheu Thai

meaning, it only happens in autocratic/dictatorship type countries and/or banana republic countries, he's correct

What this man meant to say is that this dissolution would be waived in democratic countries, not other democratic countries. By saying other democratic countries he is implying that Thailand is a democratic nation, which it is not.

 

When elections are stolen because a candidate who is too progressive wins an election, based on the will of the people, that is the opposite of a democracy.

Dissolving opposition seems to be popular in Asia.
