If the nudity is offensive i.e. done with one or other partner being ugly, short, fat, gross, old etc then it is never acceptable under any circumstances. I used to be attractive naked but since putting on an about 20kg, I have become less attractive than before and hence reduce my naked balcony play to the dusk, evenings and hours of darkness. Leaving the lights on the balcony on, adds to the viewership, but also adds to the mosquito problem for the most delicate tissues. The only applicable law would be Section 388 of the Criminal Code, Public Obscenity, in which the act has to be in public. Is your private balcony public? Maybe the person watching you naked, in your own home, would be the one actually committing an offence or breaching etiquette? If you are looking from a public space into private property, the looker maybe considered a peeping tom, and therefore committing a crime. One night, one of them went to the balcony naked by mistake, and somebody yelled out at her from outside my condo boundaries while driving his motorcycle. I'm glad that he did not had an accident.
