This isn't about Trump as much as you want to divert the subject. Answer this question. Why is Fauci rumored the be on the list? Surly if he's not guilty of anything there's no problem. Same as the rest. Of course if you mention lawfare as a reason you may be on very thin ice. Not neccessarily. They went after Trump on nonsensical charges such as the expired misdemeanor and made it into 34 felonies. Nobody in the world even knows what the felony was and he was unable to defend against this unknown felony.

BTW, if they managed to do so, just imagine what Trump could do with preemptive pardons? If they could do so, then so can every president in the future.

 

Correct - you need to accept your are guilty before being pardoned. There are legal ramifications including the loss of the 5th Amendment right if you are pulled before a Congressional inquiry or Grand Jury. 

 

The notion of pardoning a "phantom" crime would almost certainly end up at the Supreme Court. Before that happens, Hunter would need to be charged with a felony that occurred with the pardon period. SCOTUS wouldn't take it on until 2026 at the earliest, we'd maybe see a verdict in June that year, otherwise 2027. 

 

Jack Smith is already being investigated for misconduct by the DOJ, it will be interesting to see if he is given a "phantom" pardon.
