THIS IS FALSE. Foreigners in Thailand, including Americans, are generally not allowed to own land outright (There are exceptions, like BOI, Sap Ing Sith, etc.) This restriction applies equally to all non-Thai nationals. Some Americans are confused by the Treaty of Amity between the United States and Thailand, which does grant certain business privileges—such as allowing Americans to hold a majority of shares in a Thai company for business purposes. However, this treaty does not give Americans any special rights to own land. It only relates to business ownership and operation, not land or real estate. What you talk about is a RUMOR and GOSSIP from Internet. But... there is a law allowing 1 rai for ANY nationality. A Thai decree is about it but major investment must be made and I never seen it for 1 case. An investment of at least 40 million baht in specific Thai assets beneficial to the Thai economy, such as government bonds or property mutual funds. Approval from the Minister of Interior. The land must be used solely for residential purposes and be located in designated areas like Bangkok, Pattaya, or other municipalities. There is also section 96 bis of the land code and not the Thai decree that i know. Similar and I heard of another new law saying the same. It is NOT for Americans, for any nationality but needs 40 million investment. Even with this exception, land ownership requires approval from the Ministry of Interior and is subject to conditions such as the land being located in a municipal area like Bangkok or Pattaya. Moreover, this permission is not transferable and does not extend to heirs if the foreign owner passes away. So, in summary, Americans are not treated any differently from other foreigners when it comes to owning land in Thailand. The Treaty of Amity is relevant only to business ownership, and the 40 million baht investment exception for owning 1 rai of land is available to all nationalities, under strict regulation and for personal residential use only. -
