No clue what it is called, or what is needed.

Currently on Elite, Expires November, but have 6 Months Free till May, not going to renew as Elite has become toxic (all the Chinese criminals using) and the perks that were there have evaporated over time, i.e you used to just inform them you are coming but now need to give 5 days notice etc, or if you wish to remain without leaving (like i have done since 2020) its now 45 days (all criminal background checks etc.

Doesn't make sense when you still have to do 90 day reporting and the only perk is immigration printing all the paperwork.

So considering my options (too young for Retirement visa) so that leaves LTR, Parent, Marriage, LTR has been problematic for a lawyer i know so not gonna bother with that, marriage doesn't suit to be at her behest, have three dual national kids (Thai citizenship) all in education (as Thais, international school).

I think there's a visa for dependents my friend has but his kids are not Thai.

Regarding your Thai children do they live with you?

So to be clear.. You are the father of the children and not married to mother. Also do not live with mother or children? 

 

 You did not mention DTV which depending on your age might be an option to cover you till 50 yr age

LTR is by far the best option.  I'm not sure what your friend's issues were, but each case is processed on its own merits.

 

If you were not married when the children were born, then you do not have legal parental rights to the children.  

You would need to get that first, either through the courts if they are too young, or through district offices if they are old enough.  I'm not sure of the exact ages.

But you also have to be the one actually in custody of and caring for the children.  You cannot get a visa just because you knocked up a Thai girl.

Married to her yes, but don't want to be beholden to her for a visa (its why i did elite previously).

Kids live with me (us) and i am on the Birth certificate, i just don't want a marriage visa.

Just one opinion. ... You are making easy into difficult. 

Especially as you live with wife and children. 

You won't be able to obtain children as your dependants. 

That would be possible if divorced. Immigration would direct you to Non O marriage. 

The wife would need to attend immigration for extension however nothing that a gratitude to wife wouldn't fix. 

 

You quickly ruled out DTV seemingly on one person's experience. 

If 45yr + it would be easy fix till obtaining Non O retirement

Immigration would make you obtain Non O + extensions based on marriage. 

Many would opt for based on parent of a thai given that option. 

 

Here is quote from ubonjoe on the matter... 

 

"Some offices will not do an extension based upon being the parent of Thai unless you are divorced. Some might do it if you were separated from your wife and she had formally granted you custody of your child.

After divorce you you would need at least joint custody to do the application.

It is the same 400k baht for the extension".

Applying for an extension of stay based On Thai family/spouse are covered under the same section 2.18 of Immigration orders.

You state you don't want to be beholden to your wife, but you're content to be beholden to your children.
You also state your children are at International schools, yet you be quite willing to drag them away from their studies to attend an extension application, which the wife would probably also have to attend anyway.

 

Far easier to apply based on Thai spouse than Thai family, less documentation and less upheaval for the children.

There are many many posts such as this attached one. 

Immigration will make you do the Non O marriage in lieu of parent of Thai child. 

You are not divorced. Also living with wife and children.
