Indian Man Knocked Unconscious After Argument Over Urinating

The reason hate crime legislation was established was crimes against victims of a certain nature were being dismissed by law enforcement, prosecutors and judges.

In many states in the US the "homosexual panic" (on a charge of murder) defense has been and is still admissible, as a plea if of "not guilt" or "nolo contendere", resulting in dismissal.

Many lynchings were mob violence based on unsubstantiated rumours of the rape of a white woman, and in the American South, were likewise dismissed.

Whether such need exists in Thailand is for Thai legislators and law enforcement to determine based on need and fairness, and should not be summarily labeled "rubbish" by armchair farang.

I thought the term was "bar stool farang" but never mind

There was never any need for this hate crime rubbish , anywhere, all that is required is to enforce the existing laws , and enforce them equally and without bias or favour,       Anything else is just plain wrong and only adds to the problem of two tier policing.    That it does not exist here is a testament to the  Thai legislators who have not adopted it, showing that they are not suffering from the nasty woke virus

Not sure what the examples you provided are supposed to prove,  a lynching is murder simple as that , no need to mention the word hate, murder is its self  about as bad as things get and a hate murder is no different to a love murder regardless of the sexuality or ethnicity of perp and victim

The reason the legislation was enacted was that the existing laws, already promulgated, were not and are not enforced without prejudice.

You're entirely correct. Hate crime laws need never exist, and indeed, if there is no reason here in Thailand.... then great.

And yes, to your point, a more direct approach would be to fix the law enforcement and judiciary processes so that there is no need for hate crime laws, unfortunately that has not been the case, there are perhaps those who would not want to see that happen ....state's rights and all that, for one.

Here in Thailand, like everywhere, there is a flawed law enforcement and judiciary process, however, the issue here is more the lack of enforcement and judgement against those of wealth, the 1%, and political influence, not so much race, creed, colour, sexual preference, gender, etc that hate crime legislation elsewhere attempts to address.

PS : I like that better, "bar stool farang", more fitting the Thai Visa / ASEAN Now archetype. 😊

Hope he is okay. But letting in Indian visa free was a disgraceful decision by Thailand.

A hate crime is a criminal offense motivated by prejudice against a victim's perceived or actual race, religion, disability, sexual orientation, ethnicity, gender, or gender identity. It involves both a criminal act, such as assault or vandalism, and a bias motivation. This can also include acts targeting property, and if an act is not criminal but still motivated by prejudice, it is considered a hate incident, which can be more serious than it first appears.

Elements of a hate crime

    Criminal offense:
The act must be a crime, such as murder, arson, assault, vandalism, harassment, or bullying.

Bias motivation:
The crime must be motivated, in whole or in part, by bias against a protected characteristic of the victim or a group they are perceived to belong to.

Examples of protected characteristics

    Race or ethnicity
    Religion or belief
    Disability
    Sexual orientation
    Gender or gender identity
    Age
    Nationality
