Immigration Suggested Purposefully Overstaying!?

I'm doing my 2nd marriage (non-o) visa renewal.

About a month ago, I had to go to hospital and had no choice than to use some of my 400k I've put in my Thai bank account.

The money was reimbursed 2 days later.

 

Immigration in Phetchaburi however told me that because I need to have the money in my account for 2x months, that I cannot do the visa extension. I have two options:

1. To leave the country and apply for a new visa

2. To purposefully overstay for about 10 days (by that time, I'll have 400k for 2x months) and pay a fine of 500B per day

 

I cannot do a short 1-2 month extension of my visa because I did that previously on my first renewal (I'm renting, and the landlord didn't want to provide documents, but that's a different story).

 

Is purposefully overstaying under these cases common? I try to do everything by the book and I don't want any potential for future problems, such as no longer being applicable for citizenship / permanent residency in the future, being blacklisted or being apprehended, etc.

It's not uncommon for folk to apply for extension few days later (eg 3) and immigration accepting to process the application albeit with fine 500/day.

10 is out there. Bit surprised. 

Some others will post first hand experience. 

Did you suggest to immigration that perhaps a "fine" would be better option. 

 

Edit: marriage extension. Immigration office has less flexibility

I do believe I mentioned this in the original post, but:

Yes, I suggested the extension, but they said it's not possible due to me already doing that on a previous renewal.

They suggested the fines for 10 days overstay as the best option.

 

I was a bit surprised by this suggestion though, thus this post.

I am also. 

Of course starting over is an option. 

Would have been good to ask them if they would accept application for a Non O marriage from visa exempt entry using TM87. 

You have the Thai bank account + funds in place. 

Your location is not great for border run, however an option (messy) 

@Tod Daniels any suggestion. 

It is not unheard of at all to have an immigration office suggest that you run on overstay if your seasoning is coming up short and you already burned through the one 60 day visit family extension you're allowed. 

Several years ago in Bangkok I had somebody forget their renewal date and we went to immigration's with a 38-day overstay, all the paperwork needed for the retirement extension and 19k in overstay fines. 

The officer told me that had he ran over the time in which you are fined (which is 40 days at 500 per day), she would have denied the extension and had him leave. 
BUT
Because in essence he was paying 500 per day to stay (on overstay fines) she allowed it. 

And he was issued his extension with no issue after paying the 19k in overstay 

I have seen them also do it for people that need two weeks or 3 weeks so what was suggested is not unusual. 

And that they even suggested it shows that they are trying to find a way in country for you to get yourself out of the hole you dug for yourself, without leaving/coming back in and starting the whole process from scratch 

I would take their offer and during that 10 days that you are running on overstay while you wait for your funds to season the two months required I would make sure that you didn't run yourself off the rails with some other issue involving the police 🙂

I would also say the overstay fine is a viable option 👍

Face it you're up in Nakhon Nowhere 😮 and getting you to the border out of the country and back in either by land or air is going to be an ordeal. 

 

Keep your head down for the 10 days you're on overstay, show up the day your funds are seasoned the full 2 months with all your documentation and your Thai wife in tow and apply for your yearly extension

It would have been good if you could have gotten something in writing and signed from the io to say that a visa would be granted after you've paid the 10 day overstay.

Indeed, I'll be keeping a low-key during the 10 days overstay. I'll just chill around at home until I get my extension done 😁
