Yes, this has been suggested by some Thai tax prep companies. Filtering thru an offshore bank account would have income converting to a gift - pre arrival in Thailand. Thus, remitted monies would have the same non taxability as a remitted bank loan. Problem -- giftee not having a foreign bank account.

    No, you don't. If the funds aren't earned in Thailand, nor remitted to you ( you being the donor), there's no thai tax liability for you. The recipient has no tax liability either, as under the gif

Indeed. But practically in the real life what's gonna happen IF the giftee is audited?

Case 1:

TRD: Is this inward international transfer from this account in your name foreign income?

Giftee: No, it's a gift from my husband.

TRD: OK.

Case 2:

TRD: What is this inward international transfer from Mr "Husband Name"?

Giftee: It's a gift from my husband.

TRD: OK, we're then going to audit your husband to check if this remittance should be taxed. OK.
