Work Permit Application With Expired Non-b But Still Valid Entry Stamp

Dear board members,

I have to apply a work permit based on a NON-IM-B Visa. My issue is that my NON-IM-B Visa expired on May 10th, 2010. However, I last traveled abroad in April and returned on April 15th, 2010. This I still have the permission to stay in the country until July 13th, 2010 as per my entry stamp in my passport.

My questions is whether I am still eligible to apply for work permit with an expired NON-IM-B Visa but a valid entry stamp until July 13th, 2010.

In the case that I have to apply for a new NON-IM-B, do I have to travel to my home country or could I apply also at a Thai embassy in neighboring countries (Cambodia, Malaysia) or countries within Aesan but having no border to Thailand like Singapore or the Philippines.

You can apply on a tourist visa - only the issue requires a non immigrant visa entry and you also have that so no problem. You will either need a new visa or extension of stay before July 13.

Thanks for advice. However I don't understand why I would need a tourist VISA. The company will apply for my work permit within the next few days. Then my entry stamp received on the by now expired non-im-B VIsa is still valid. Shouldn't that be enough?

I never heard that a tourist VISA qualifies for WP application, but my information might just be outdated as regulations change so fast in Thailand.

^^^ You don't actually REQUIRE a tourist visa, lop was simply noting that you can apply for a WP even when here on a TV.

Only the actual issue of the WP needs the non-immigrant entry. Indeed some consulates need the receipt for application of a WP (WP3 IIRC) before they will issue a non-B.

Provided your new WP is issued before your current stay expires you should be good to go, otherwise it's another trip out for a new visa.
