90 Day Report -Date Fell While Visa Was Under Consideration?

Featured Replies

I received a 1 year extension, of my Non-Imm "o" visa (based on marriage) on July 12, 2010 (according to stamp). It permits me to stay until June 14, 2011. I just noticed that they did not update my slip for 90 day reporting. It is still showing that I need to report June 14, 2010 which is when this new visa would have been under consideration. I applied for the extension a few days before June 14.

Is this my mistake? Or should they have updated it during the 1 year extension application process? Or will they simply understand that they did get my address reported during this 1 year extension process?

The stamp says that overdue notification fine will not exceed 5000b! Don't really want to pay that right now! Any advice or insight into this would be appreciated.

You should not have needed to report before you applied for an extension of stay as a visa entry only allows 90 days and no report is needed. How did you have a 90 day report for June 14th?

Did you have an extension of stay before? In that case you were required to report on the 14th and failed to do so and now should and pay the normal 2,000 baht fine.

Only the first application of extension of stay counts as a 90 day report.

I got my original non-imm O visa in March 2009, valid till June 14, 2009. At that point, I had a 1 year extension till June, 2010. So this past June, I got another 1 year extension. During that process, days before my scheduled 90 day report, I would have given my address, map to my house and everything to get the 1 year extension. Does this not count as an address report?

I have a re-entry permit already as I am supposed to be going to Canada soon. If I just go and come back, will it be forgotten? What happens if the 90 day report card is lost when I return to TL?

No, only the first extension counts as a 90 day report. After that it are two seperate things.

If you ignore do not be surprised to find that they catch it on the first report after you return as they will be making a closer than normal inspection with an overdue/no report. The stamps in your passport will clearly show you failed to report while in Thailand. It may still be 2k as that is normal if they do not know your are hiding it but it could be 4k if they want and it could be up to 5k plus 200 baht per day under regulations.

While this doesn't make any sense (why don't the subsequent extensions of stay count?), I will believe you.

Another thing about the 90-day reporting: When you live here, Immigration will issue some statement of residency, or address certificate, which is needed for the Driver's Licence or for applying for a Credit Card, or other uses. Immigration will issue it for free, while the alternative is that your embassy issue the certificate for a heavy fee.

Well, I had to renew my driver's licence earlier this year, and a change of residential address was involved. Immigration says they can't issue an address certificate because I never stayed in Thailand for more than 90 days (I'm out on business once a month on average), so they have no 90-reporting reference on me and therefore cannot issue the required form! Apparently, the address you fill in the Arrival Card doesn't make it into the immigration's computer, only the address in the 90-day reporting does. I had to get the expensive letter ("Confirmation of Residency", confirming my address) from the embassy.

Ok, I got it sorted out. Before going, I briefed the wife in detail as I know these guys don't have the best listening or understanding skills. When we got to the officer, I just started speaking slowly and politely as possible for maybe 10 seconds when he interrupted me naturally to give me the answer before I got to any question or anything. Anyways, my wife jumped in and explained it in Thai. He actually listened and was polite to her. He explained that he will give us a break this time, but never again. She explained that this was a new situation from us, and we have learned. After that, she sat down and I proceeded with my next 90 day address report. When completed, I gave him a wai and said "kope khun mak krup pee" and he didn't even acknowledge that I exist. I smiled and walked away...not that he noticed. So the situation turned out very well in the end. I didn't pay anything and it didn't even take long.

I still find it very strange that giving your address to immigration during the 90 day reporting window for application of a visa extension does not qualify as a 90 day report.

As said they are two totally different things.

Although having said that when I extended my 12 month stay at Khon Kaen Immigration recently the Officer processed my 90 days at the same time even though it was not due for weeks.

Ya, that's exactly what I mean. My 90 day reporting date was two days later. I assumed they would have processed that since I was giving them my address at that point.

If you had provided a TM.47 they would have.

If you had provided a TM.47 they would have.

This is the crux of the matter in these situations. Unfortunately irrespective of whether your extension is the same day, week whatever of your 90 day report if you haven't filled in a TM 47 you haven't reported.

That's what goes on file as official notification of reporting.

Ya, I suppose that does make sense.
