hi everyone, this is my first posting, i hope i am not going give anyone a headache.

my wife (thai) is going to apply to visit me in holland on either a 30 day tourist visa or a 3 month tourist visa.

my situation.

i am english, i have my own small buisness that is registered with the chamber of commerce(kvk) and i am registered as living at my address in holland with city hall (gemeente).

i have telephone records, itemised bills, to show weare in regular contact.

i am sending her a letter inviting her over on holiday.

i have a reservation letter confirming i am going to thailand on dec 17.

her situation.

she has 1. marriage certificate

2. 100,000 bht in her bank account

3. 520,000 bht in joint bank account

4. a letter from her employer stating that she has employment to go back

to when she goes back to thailand. (insert dates later)

5. passport , with my name.

6. title deed 10 rai of land.

still to get,

book a flight for her , with at least 30,000 euro of medical cover

i think this will suffice for the 30 day visa, for the3 month visa i may

have to upgrade my private medical insurance in holland to cover her

(i am not being flash , it is compulsary over here).

final questions.

1. does anyone have information of the procedure for the interview at

the dutch embassy in bkk.

2. isthe 30 day visa easier to get than the 3 month one

As you are a national of an EU country exercising your right to work/establish a business in a second EU country, the visa for your wife should be a formality; either to visit or reside. Being British, you are legally allowed to live and work in the Netherlands as, by extension, are your immediate dependants.

As you can see from the link, once you have established that your wife is a dependant of yours (show your marriage cert. with a translation) the permit can only be refused in very limited circumstances and must be issued without formality. There is no requirement to show any financial documents or prove an incentive to return, but I would support the application with evidence of your business and, of course, your British passport.

The beauty of your situation is that, as you are a resident of an EU country other than the UK, your wife does not need a visa to reside in the UK either. Should you wish to go to the UK to settle, she can apply for a family permit at the British embassy which, again, is free and issued without interview.

thanks scouse, before i re visited my post i was reading other posts and your name came up alot, along with a few pats on your back, so i will add mine to them, thanks.

if i read the relevant passage correctly all i must do is ,

go along to the dutch embassy in bkk with proof that i am a european citizean, with proof that i have my own buisness in holland, with proof that i have my house in holland , and my translated marriage certificate.

if i sent her this documentation would she be able to go to the embassy herself or would i have to go to bkk and apply for her?

Your wife can go herself, but it may be advisable for you to complete the application form on her behalf, scan it and e-mail it to her. She then just needs to sign it. She should also take the original marriage certificate and, perhaps, you could have the copy of your passport notarised by a lawyer in Holland before sending it to her.

many, many thanks scouse.

only two things to clear up,

1. does she need a valid air ticket before she submits the application, or can she get one once she has the visa(shewould fly out the next day).

2. when shereturns to thailand with me in december, will she need to reapply in january when i return.

thanks scouse,but the visa i need is called a EEA FAMILY PERMIT

the website you gave me yesterday is located in brussels , i phoned them this morning and they told me that the application must be made from the dutch embassy in bkk.

i contacted the embassy to see if they could send me one so i could see what documentation was needed and they saidthey had never heard of it.

they told me to phone back tomorrow when the head of dept is in (between 2 and 3.30), good job if you can get it.

anyway went on google tapped in eea family permit , andlow and behold there is a application form.

i have downloaded it and sent a copy to thedutch embassy in bkk.

this form has been in existence for 4 years, but no one has let on about it, i wonder how many '"irish guys"living in england have been given the run around when it is so easy to get this right of residense.

to all brits who can get a irish passport,do it , becausethat will be your only expense ,the family permit is free.

tap on to google, tap in eea family permit, and there is lots of websites to tell you what documents you need

Hi Cheekie,

I think it is common for there to be a lack of knowledge about family permits within various embassies because they don't get many such applications.

With regard to the application form, I do believe you can complete just a usual visa form, only answering the questions which relate to a family permit application. Certainly, that's what the trouble and strife did when she applied for her family permit for Germany. However, if you have a specific form, then so much the better (please can you send me a copy, if you do?).

when i got the download, it was for the u.k.,the form you must have is a VAF 1-NON SETTLEMENT (PDF,130K).

I UNDERSTAND ABOUT THE SCHENGEN VISA,BUT THE WEBPAGETHAT YOU GAVE ME YESTERDAY CONCERNING HOLLAND, STATEDTHAT THEVISAMUST BE GIVEN ANDIT COST NOTHING, WHERAS THE SCHENGEN CAN BE REFUSED AND DOES COST.

Hi Cheekie,

It's the application form from the site of the Dutch embassy in the UK. The form can definitely be used for family permit applications, as this is indicated therein and, indeed, it's the exact same form that Mrs Scouse used when applying for her German family permit. I quote question 43 from the form to which I posted a link:-

43. Personal data of the EU or EEA citizen you depend on. This question should be answered only by family members of EU or EEA citizens.

Name                        First Name

Date of Birth Nationality Number of passport

Family relationship :

Honestly, Cheekie, this form can be used for EEA family permit applications.

hi scouse, thanks for the effort.

i contacted the dutch embassy in bkk,and yes it is possible to get this family permit, one big obstacle is that she can not travel alone, so i would have to go to bkk to get here, also i am one document short, a european card.

normally i do not need this as i have right of abode ,but to bring her across i would have to show that, along with translated wedding paper.

this normally takes 2 month to get.

however,he give me the telephone number of the dept in immigration that deal with community family permits andthey told me the best course of action to take.

1. i go to city hall and apply for european card.

2.get wife to get 30 day visitors visa(shengen).

3.when she arrives in holland, go with her to city hall , andshe applies for european card, her 30 day visa is cancelled and she hasthe right to stay until a decisionis made. if the decision is no, shecan appeal on the rights of community law, and she can stay until this decision is made,and under community law they have to give her(so long as my paperwork is in order)the european card.

she can then apply for a residency card under the same law.

they told me there is to much red tape when you apply at the embassy in bkk!!!

anyway will let you know how i get on cheekie

i last posted on this subject on 30 august.

the story goes on,

i got the documentation i needed, letter of invitation from city hall,application form for visa,proof of employment and 2 photocopies of my passport, sent them to thailand on 2 sept by courier(50 euro), they arrived 6 sept, my wife went to bkk today, i got a phone call at 5 am to send a fax to the dutch embassy with a hand written invitation, sent it off, 1 hour later my wife called me to tell me she is to pick up her visa on monday.

maybe i was lucky, there was only 3 people in the embassy all morning, but they wre able to process the documents while my wife was there..
