Good Day All

My Thai wife first came to Scotland on A tourist visa 3 years ago ,We got married and she returned to Thaialand for a 2 year Leave to remain visa at Bkk uk Embassy ,

This Visa Expires in December of this year.

My Question is ,Does anyone know what type of Visa is required now ?will it be an extension on leave to remain or a permanent residency visa ?We have a son together will this make a difference ?

We plan to move to Thailand soon within the next couple of years but we will return to Scotland occassionally for a Holiday ,Would i require to get a Holiday Visa every time we returned to UK ??

Any Answers on this subject will be greatly appreciated

Moved to the correct forum.

One month before your wife's 2-year stamp expires you should apply to the Home Office for indefinite leave to remain. You will need to show that your marriage is still subsisting and that, as of the date of application, your wife can be maintained and accommodated without recourse to public funds. Once your wife has indefinite leave, she can come and go without having to secure another visa, as long as she spends no more than 2 years outside of the UK. Technically, for your wife to continue to benefit from her ILR she needs to be resident in the UK and, on that basis, she would require visit visas when wishing to visit. However, providing her ILR hasn't lapsed, it is likely that the immigration officer will not insist upon her having a visit visa. NB. The immigration officer, if he wished to be offcious, could insist upon your wife having a visit visa despite being in possession of ILR.
