Hope someone can help me with some information.

I am planning to take my sone back to the Uk in March (School Holiday) just to meet family and friends, my son has a Thai passport and birth certificate, not processed UK passport yet!!!!

I took my wife back to the Uk last year for 2 months and had no problem with obtaining a visa it was issued the same day!!

Can someone tell me if this is the same process and what documents i will need.

Hi Mike,

You've 3 options:-

1. Apply for a British passport for your son (presuming he qualifies);

2. Apply for a right of abode vignette which is placed in his Thai passport but confirms him as being British;

3. Apply for a visit visa as a Thai national.

If your son does have an entitlement to British citizenship, yet you still choose to present him as being Thai and apply for a visit visa, I don't see how the embassy would dare refuse it. I would, however, still enclose all of the relevant supporting documents including evidence of your ability to pay for the trip and accommodation, as well as a letter from the school confirming that he's expected to return. Also include evidence of your status in Thailand.

March is still enough time to lock in the British PP etc? If you are going to the embassy anyway, it may as well be for that, rather than the visa?

Thanks for the information but i am a little confused as i have been told that to obtain a british passport it takes between 6 - 8 months, which is why i was going to go to Had Yai get him a thai passport as i live in Trang in the South then go to Bkk to get him a visa then sort out the British Passport when we come back, my son is only 1year and 2 months so letter from school is not needed but what other docs would i need apart from birth cert money in the bank to show i can support him and myself for our stay photos

Oh and bye the way Scouse good luck for the weekend you will need it mate LOL UP THE SPURS

May I ask who told you that to obtain a british passport it takes between 6 - 8 months? If he is already a UK citizen, then it shouldn't take long to obtain a British passport.

A passport or birth certificate takes 7 working days from receipt of a completed application.

Satisfying the requirements, in particular with relation to the photographs, may be the most difficult and take longer! As it is a first passport, you also have to have one of the photograph counter-signed by someone acceptable.

He is automatically a British citizen if you, his father, are a British citizen otherwise than by descent and married to his mother at the time of birth (or perhaps even afterwards).

If he is not automatically a British citizen, then it may be possible to register him as a British citizen at the Home Office via the British Embassy. I think that there is normally a time limit of one year for submitting the application, but can be extended up to six years by descretion. This is the process that would take a long time, perhaps up to a year.

Cheers for the info Vinny, well as i said he was born here in Trang 1year and 3 months ago on the 19th i am the father and i am a British Citizen but he has not been registered as a British citizen only Thai.

So we only have a Thai Birth Certificate, can i do the necessary paper work for his British Citizen and passport by ems post or do i have to go to BKK myself, which is a pain as i work here as an English teacher and time is something i dont have until the half term but that is when i plan to go back to the UK.

Can you help me any more just checking out your links so hopefully they will be helpful, thanks again for your help

If you were born in the UK, naturalised in the UK or (in some, but not all cases) registered in the UK, you acquired your British nationality otherwise than by descent. If you are British otherwise than by descent and was married to your son's mother at the time of his birth then he is automatically a UK citizen.

In this case, you may, if you like, register his birth at the British Embassy at the same time as when applying for the British Passport. Registering his birth gives him a British style birth certificate. Birth registration is not compulsory, but they recommend it. Follow the instructions on Registration of birth page. You can also apply for a British passport for him without registering his birth at the Embassy.

I believe that everything can be done by post. You can use EMS.

Get him a UK passport may be your best bet for this trip and his future. It will mean that he wont need a visa to travel to many countries and may make his adult life a lot better. I did it with my son and i often wonder why people dont do it when they are born?
