If it takes a higher power, the courts can be just instructed that this is a matter of national security and go round the constitution court and allow the govt to spend freely. Rather than blaming everyone else for their cockups they should have been asking the questions "how can we do this " it seems that finally someone had the sense to ask for a Council of State reference about can they legally take loans to honor existing known debt. It seems they said yes. Therefore clearing the legal hurdle that was stopping the banks from lending.
