Thaksin’s aide gets six years in jail

BANGKOK: -- The Samut Prakarn provincial court today sentenced Apichat Chansakunporn, alias Sia Pieng, managing director of President Agri Co Ltd, and a close aide to ex- Premier Thaksin Shinawatra, to six years in prison after finding him guilty of embezzlement of 20,000 tons of broken rice, and breaching government rice contract.

The court said his company and he himself were found guilty when they failed to ship to Iran 20,000 tons of rice worth 200 million baht they received from the Commerce Ministry for improvement but embezzled them with intent for sale to another country.

They were then guilty of breaching rice contract with the government and also of embezzlement.

The court then sentenced him to three years in prison for each charge and a fine of 6,000 baht each.

In all, the court said the defendant will serve a combined prison terms of six years and a fine of 12,000 baht for the two charges he was found guilty.

Sia Pieng later posted bail for temporary release and said he would appeal the sentences.

Not followed the whole thread, but he has been found guilty, 6 years in jail, then out on bail????

Appealing the sentance should not mean bail for appeal, you appeal in jail. Dont give a fling fxxx if he is a mate of a Thaksin member, or a yellow arse, he has been found guilty.

Though I want to agree, it is quite normal for people in other countries too to appeal and be out on bail (unless flight risk or dangerous). However here it becomes never ending appeals and keeping them out of jail forever.

Plus they should really go after the money he made here not just jailtime.

The 'higher' the %% of "broken" with regards to rice-quality, the 'lower' the value/price of the rice. Therefore; by stating "to re-build", they mean, in fact, to defraud, because they were aiming to receive the (substantially) higher price for the (substantially) lower quality of rice.

It's much the same as selling someone a Benz C-300, but sending him a Benz C-180 . . . . . . . . . .

The investigation and trial must have cost the country millions and that is not taking into consideration the profit he has made.

And all they get back is12,000.

There should be assets seized to at least the estimated loss to the country from his illegal activities plus the costs of investigation and prosecution.

Bail hearings should be separate and only after he has done several months in a cell.

Then OK out on bail, but with an ankle bracelet and passport withdrawn.

No need for the country to pay for his keep. But he (they) should be charged the cost of bail hearings.

The tried-and-trusted trick to avoiding imprisonment: A hefty prison sentence to save the justice system's face. A token fine. Bail. Then appeal, don't turn up for the hearing - Repeat. A few bribes here and there. The case drags on for years, is swiftly forgotten about, expires.

But maybe the current government will discard the old ways and mete out justice to the parasites and snakes. thumbsup.gif A change for the better, hopefully.

The achingly slow movement of the justice system here is something that needs changing. As you say court cases can drag on for years if you have the money or the guilty can leave the country & return when statute of limitations expires.

Why does everyone ASS U ME that the exodus will be to Dubai just because Thaksin is supposed to be there? It's a shit hole, has more insane laws than Thailand, why not just move to Cambodia, or Singapore?

6 years in Jail for 200M baht V's 15 years in Jail for 250mg cocaine.. Time to overhaul the Thai courts system too, it would have been better to have give this knobber 15 years and the model 6 years..

Ohh the naivety of some is nothing short of hilarious. Read the article again and again if necessary then join the dots.

Your knowledge of this very long-running and actually complex case, and of this man himself, seem to be based on a single, short newspaper report. If you google this person's name (proper spelling Apichat Chansakulporn with an "L", not "N") and "watana muangsook", things will come clearer for you. Add "president agri trading" and they will come clearer still.

The court was told they took place during the Yingluck government when his company failed to deliver 20,000 tonnes of 5 per cent broken rice destined for Iran.

The court said the defendant violated the contract signed with the Commerce Ministry and embezzled the rice after his company sold the 20,000 tonnes of rice, which his company was obligated to deliver to Iran, to another country.

I'll wait for the court decision.

If guilty, nail him hard. If not guilty, let him free.

This court case is not going to change Thailand or TVF.

People that say Thaksin is Lucifer who never had any positive policies will keep turning a blind eye to yellow depravities. People who think Thaksin is a saint just because he got elected will keep dissembling and shouting elitism.

At least the current leader so far is keeping his promises, which is more than can be said for any politician from my home country. I gave the General a B-, the Thais, according to a Dusit poll, gave him a B+.

He is guilty and out on bail. I expect him to flee the country and join Jakrapop and Jurupong.

If I read it correctly he got 200 million Baht from Yingluck's government to deliver the rice to Iran but he never delivered the rice.

Anybody ever wondered why the Shin clan is so rich....

I checked it out and it is true. The Yingluck Shinawatra government prosecuted the case.

And not a single response to that from the yellow ranters, except one mumble about 'well that means the Shins couldn't stop it'.

A yellow ranter is no better than a red ranter...he just has a few more friends since the coup. Drop Imelda Marcos a note and she'll jump in too, along with the Ghost of Saddam Hussein and Fidel Castro as escorts to join the little yellow tea party.

A Shinawatra government prosecuted this guy, who is allegedly a Shinawatra lacky .... um, the logic is astonishing, followed by 'root out the evil' and 'I hope the court does the right thing and goes after the rest of them' and the famously idiotic 'there go the last PTPs on earth.'

Thai law is designed to favor whoever is in power, and they are not killing that cash cow just for Thaksin Shinawatra, or any of us.

You're buying what they're selling and calling it a discount.

Sentence will probably be bargained down, they should have made it longer and the fine should be for the full amount lost. The laws need to be changed so that the fines match the crime and the judge can fine accordingly under his or her discretion...Still nice to see some small measure of justice done....
