Yingluck petitions Prayut for fair trial

BANGKOK: -- Former prime minister Ms Yingluck Shinawatra today sought justice from Prime Minister Gen Prayut Chan-o-cha in the latest petition over damages to the state from her rice pledging scheme.

Her petition was posted on her Facebook “Yingluck Shinawatra” today and also submitted to the prime minister by her lawyer late this morning to the Government’s Complaint Centre.

In the petition, she said Gen Prayut’s issuance of Order No 39/2558 to provide legal protection for government officials to manage remaining rice stocks kept in government controlled godowns was unnecessary as the statute of limitations which he feared was not a problem because the government can demand compensation from the damages when court case ends.

She said such issuance of order merely showed the prime minister was in a hurry to speed up the rice pledging case, and was tantamount to breach the justice system, and was unfair for her who has become a prime defendant in the case.

Besides, she said the issuance of Order No 448/2558 by the Finance Ministry under the prime minister’s order to appoint a committee to assess the amount of compensation to be demanded from defendants in the rice pledging scheme within one year is hasty as the statute of limitation of criminal charges in the rice pledging scheme case carries on up to 15 years.

She insisted on her innocence in implementing the rice scheme and stated she was ready to defend herself under the justice system.

But the hurried manner which the government was managing the case was merely to obstruct her to have enough time to collect evidence to defend.

She suggested the best option for the government was to resort to civil court to demand compensation rather than resorting to invoking Section 44 of the interim constitution for payment.

Yingluck begs for justice from Prayut

BANGKOK: -- Former premier Yingluck Shinawatra has written an open letter to prime minister Prayut Chan-O-cha seeking justice over the current government's attempt to seek a massive compensation for damages caused by the previous government's rice-pledging scheme whose losses are estimated to be around Bt600 billion.

Yingluck, who is facing a likely civil compensation lawsuit, said there are two inaccurate reasons reported to Prayut concerning the latest legal attempt. First, the prime minister was told the civil compensation case has a statute of limitation of one year and if the case is filed under the Tort Liability of Government Officer Act B.E. 2539, the statute of limitation would be 2 years.

Secondly, the case could only be executed under the Regulation of the Office of the Prime Minister on the tort actions done by government officer B.E. 2539.

In the letter to Prayut, Yingluck said both reasons were not accurate as she argued that the statute of limitation will not start until the criminal case against her under the criminal code section 157 to the Supreme Court's Criminal Division for Persons Holding Political Positions is done. Therefore, the civil case's statute of limitation must comply with the criminal case's statute of limitation of 15 years according to the Civil and Commercial code section 448.

As a result, the statute of limitation in this civil case is therefore 15 years in accordance with criminal code section 157, not 1 or 2 years as reported to the Prime Minister, according to Yingluck’s letter.

"I urge the Prime Minister to check the two suggested legal issues with the Office of the Council of State in order to provide justice to me, the accused and to provide sufficient period of time to officers related to this case to investigate facts and evidences."

"If the facts are as I suggested, the fact finding panel will then have sufficient time to fairly investigate existing evidences and witnesses including experts. The case then will not be so unfairly accelerated that I, the accused, can have a fair trial," Yingluck said in the letter.

She also said if the government decides to file the civil charge against her in the Civil Court, responsible government officers will have sufficient time to thoroughly and justly investigate the case and the National Council for Peace and Order would have no need to issue the NCPO order number 39/2558 which is against "the rule of law" and discriminating.

Exactly!!! If she wanted to file an official petition there are many official channels to use.

She is clearly just trying to drum up support from her base (or the base she had when they were being paid to be her base).

I seriously doubt if Prayut has friended her on Facebook anyway.

Maybe she could send him a couple instagrams while she is at it???

Why put it on her facebook page? Why not - is the act of doing so a sinister development? In case it escaped your notice this perfectly reasonable request for a fair trial was also reported by "The Nation" and Thai PBS, it being an open letter. The target audience being anybody who wanted to read either a Thai or English language version of that letter.

As far as the rushing plea is concerned, if you had read the open letter as reported in "The Nation" you would have seen the explanation for her reference to "rushing the case".

As for your last point, there is no reference to HM whatsoever in either the Thai PBS or the "The Nation" reporting. I can only assume you meant PM, as Prayuth refers to himself, and if you can't see why the "PM" was, in your words, dragged into this, there is no point in discussing this further.

Why put on her Facebook? As if you don't know that the junta has banned all political party press releases and warned all media operators that they face prosecution and even sedition if they air news that are critical of the junta. Social media is the only place to put your views for now. May not be long before the junta block that too.

Talk about being thick headed and not having a clue. She was Prime Minister, and in all that time she never discovered that "justice" in Thailand means those in power get their way, even as she and her brother practiced it.

seems her legal team are working overtime to stall this, everyone knows she has the mental abilities of a 10 y/o and is incapable of understanding anything let alone being able to even write something like this. Her legal team are simply using the internet in the hope of stirring her brainwashed sheep into backing her up, the sooner she is locked away the better, taking all of the ill gotten gains from the shins wont go astray either

Let's all be thankful she's not suffering from some blood ailment.

Don't jump the gun here. There is still plenty of time to play the health sympathy card.

I will bet a months salary that if this heats up enough and there is any chance of real jail time (not holding my breath on that), that she will come up with ready made illness of some kind.

Or she will be in Dubai lickety split.

Well, based on what would she expect an unfair trial? Bad memories from her days as a PM?

No reason to go for unfair trial; plenty of juicy material around to make this entertaining and unfair would only be if she would be rewarded compensation for having screwed the country like nobody before

They all claim there good Buddhists and care about others. But when it all said and done they forget there religious duties and cares to others.

Prayut is one that has famed the land with his army horay gala landing... His also one that is not liked by the people. He only thinks they like him

He can plan for next decade but he will not be leadrer to use it. And theres a huge chance that all hism installments shall be canceled anyway

Never did anything, what do you mean.huh.png She went on plenty of State visits around the world (free flights 1st class), got lots of handbags and watches.clap2.gif

Justice? In Thailand?

Those in control always persecute and prosecute their opponents.

No other Thai PM has ever been placed on trial for the actions of subordinates.

The world court is laughing at the whole fiasco. Most of the world is too. And we have some yellow tailed farang swallows from TVF migrating toward a nice self-contented land down south for the winter.

Maybe needs more time to move funds out of the country,

if she is an innocent as she claims,why would she be afraid

of going to trial,she is lucky ,she has well paid lawyers to

defend her,the common people get the bums rush and are

dealt with very quickly,and in some cases harshly,

Where is the hyperbole?

How many times did she attend parliament during her term as PM/DM? How many rice policy committee meetings did she attend as the self appointed chair?

How many times did she provide accounts for the scheme? Can she show what steps she took and how she followed up to ensure the scheme was implemented correctly and that the warnings were acted on and appropriate actions taken where necessary?

The usual "it wasn't me, I didn't know, no one told me, I'm just at the policy level, everything was o k. etc etc" won't cut the mustard anymore. She has to show she wasn't negligent in her duties.

Her lawyers seem to want to create the idea that somehow it's all very unfair, to gather sympathy and suggest any decision the court makes can only be fair if it favors her. Something Shin lawyers have always done. Claim it's all unfair, political and on occasion try the "pastry box" approach.

No doubt the Shins thought this could all be delayed, constantly and eventually allowed to simply all fade away as usual. Seems they might be wrong on this one.

Let's us say you are right and YL us right about the civil cases statute of limitations being 15 years if found guilty in her criminal case. Both go hand in hand about the same evidence and the same subject and it would not matter if the statute of limitations was 50 years. If they are ready to proceed then they will proceed any time they see fit. Her pleas are just to make her followers think they are doing her wrong by proceeding with the civil case and not drawing it out longer.

A statute of limitations only means that is when the time runs out to prosecute. It does not mean a time frame to get a case and hearing started. Clearly you are both a YL supporter and very misguided in your assessment of her letter as well as being ignorant to the laws and statutes and their meaning. Are you Thai?

Should Thailand have an election now, Taksin's chosen people will be the next government, and he will this time make sure to amend all constitutions and laws that protect this country from people like him.

Should Thailand have an election now, Taksin's chosen people will be the next government, and he will this time make sure to amend all constitutions and laws that protect this country from people like him.

Getting far away from jail seem a logical reason not only for her but all in sundry when the jail is almost a death sentence now.
