NLA reviews law to compensate wrongly imprisoned

BANGKOK, 31 March 2016 (NNT) – The National Legislative Assembly (NLA) has reviewed legislation to improve reimbursement for individuals wrongly sentenced for criminal offenses.

The NLA’s latest sitting reviewed a legislation proposal from the Cabinet on reimbursing those who have had their criminal sentences reversed. Deputy Prime Minister Wissanu Kreau-ngam explained that the law needs to be revamped as many affected are unaware of their rights and damage payments they may be entitled to.

The new legislation would mandate that such rights be explicitly made known to the individual or their relatives and that in cases where a guilty ruling is overturned, a panel be set up to decide appropriate compensation.

Members of the NLA have agreed that the law should be brought up to international standards and made convenient for those wronged. A total 174 legislators voted to approve the proposed legislation with no votes against and 3 abstentions. A 15 member subcommittee has been established to revise the draft law within 60 days.

Most people in jail are poor people who will never have their guilty plea overturned.

A poor prisoner is told to plead guilty, whether they are or not, because when sentenced the sentence is cut in half, also very, very few have the money for a lawyer, or to pay off the cops prosecutor or judge.. Thai prisons have many, many innocent victims of the Thai injustice system who will never be able to claim anything for their false imprisonment!

Yeah, this law is not for the common folk but for the politions and their friends to cash in when its their turn back in power in the revolving government game.

My husband was taken to court based on a 40 year old law, that was repealed. We showed the judge the new law, but still he sided with a government official. My mentally handicapped husband did not understand the laws and signed a guilty plea even though the law is not even used anymore. As his wife, I appealed and revoked the guilty plea. We are still fighting after 2 years and thousands and thousands of baht wasted. How can we get compensation when the judge's refuse to honour the laws in the first place? ???

The B2 if ever found to be the scape goats that they are should demand millionds of BHT in compensation.

This smells a bit of the priviliged or police that have been imprisoned, then get there convictions reversed and cop a hanfull on the way out--- what else could it be???

The B2 won't be on the list sadly,
