Ford car buyers petition for justice from prime minister

 

BANGKOK: -- A group of Ford car buyers lodged a complaint at the Public Service Centre of the Government House to seek justice from Prime Minister Prayut Chan-ocha over the allleged substandard cars they bought from Ford Company.

 

The complaint which was signed by about 700 buyers of Ford Focus and Ford Fiesta cars was addressed to the prime minister asking for his intervention to settle the conflict with the car company.

 

Led by Mr Pattanapong Ongkaew, the group has been complaining with several governmental agencies seeking justice since last August, but still without success.

Although this is bad its not as bad as the Ford Kuga case in South Africa. There the vehicles catch fire on their own due to design problems. When these vehicles started to ignite insurance companies warned Ford there was a fault with the vehicles but they ignored the warnings. Then a person died due to one of these fires only then did they recall these vehicles.

The defect is in the Ford Focus and Eurosport and involved a dual-clutch transmission.  The automatic transmission was supposed to get the advantages of a manual transmission in terms of fuel economy.  However, there were software problems and adjustment problems with the double-clutch transmission which resulted in jerky acceleration, acceleration lags, and poor gear meshing.  The Thai owners wanted Ford to buy back the vehicles, but Ford has only offered extending the warranty.  Instead of going to the PM, the Ford owners should have filed a class action lawsuit, but they may still do that.

In Thai law, here is NO such thing as a "Class-Action" !

And yet in September last year Ford agreed to buy vehicles back.

In 2015 they approve the "Class Action" suit, so I doubt many people know about it or have tried to use it yet. The law was published in the Royal Gazette December 2015.

 

It is the only way forward for these Ford owners.

Actually there is a law that supports class action. The first class action to take place is the recent suit against Truevisions regarding their cancellation of HBO and related channels.

LOL.  In December 2015, the Civil Procedure Act was amended to allow class action lawsuits.  It is closely aligned with the US model.  I should know, as I wrote one of the defining legal articles about its adoption.  No class actions have been certified yet.  The Ford owners have been contemplating it.  It is anticipated that the first class action lawsuit in Thailand will be against True for pulling its HBO channels without adequate notice.

My understanding is that the lawsuit has not been filed yet.  If the class had been certified, any premium package subscribers would have received notice in the mail.  As a premium package subscriber, I have not received my notice.

Everyone I know that's had  a Ford has had problems with it. Even a Thai Ford sales guy that lives near me has had cutting out problems. Personally I recommend Honda. I've been driving my CRV for nearly 13 years with no problems. The best car I ever had. driven all over Thailand. I think Thai 's like to buy Ford's because they think a farang brand is better. But not in my book. This is a wake up call for them. Ford is just making it worse for themselves, buy ignoring their customers, head in the sand as usual. The negative publicity will affect future sales for sure,  especially with TV news coverage. problem is if Ford doesn't buy them back, the customers will have a hard time selling them used. Word of mouth will get round. For every one dissatisfied customer he will tell at least ten others. I was a Ford owner once, also  had a BMW later. Both were rubbish. Happy with Honda. I don't work for Honda but 100,000 trouble free miles (160,000 kms), Has made me love my car so much and feel sad for the Ford customers. I hope they get their money back and have the last laugh in this case. Obviously the dual clutch design wasn't tested properly before launch. But to me Ford's reliabilty is questionable. Just my experience.

Referring to my post #11 above the class action suit is in process. As a participant, the lawyers are gathering documentation from (us) the claimants to move forward with the official filing.

Then it hasn't been filed.  I am correct.  Thai lawyers tend to be very  lazy and drag their feet.  It will be several months until they actually submit the complaint to the court.  Believe me, it will make headlines in the media when it gets filed, and we will all know.

The attitude of Ford in this matter does not not surprise me, I have bought new Toyota cars both here and in Australia for over thirty years and received excellent service and reliability

Six months ago on the birth of our child my wife persuaded me to buy a Ford Everest Titanium from the Ford dealership in Chiang Mai as it appears to have many safety features

After the sale the service was abysmal and there is still one outstanding minor issue

Two weeks ago returning home an hour out of Chiang Mai and

without any warning smoke and oil started pouring from the engine

The so called 24 four hour roadside service was a joke and we made alternative arrangements together with our six month old baby and two elderly relatives visiting from overseas to reach home

The car was left at the side of the road

The car after two weeks is still in the Ford workshop and it was only yesterday after bombarding Ford Asia and Ford USA with emails that a loan car , a Mazda , was provided , obtaining information on the repair situation has been like pulling teeth!

I think the lack of credible consumer protection legislation together with the threat of criminal defamation action allows these sort of appalling situations to continue

Whatever the merits of the individual vehicles I will never again purchase a Ford 

I will stick with Toyota as I know it with bring me home.
