Act now covers simple possession of offensive material

Bangkok-based rights group iLaw has warned that anyone with pornographic material on their computers or other data deemed illegal could be jailed.

 

The group noted in a Facebook post this week that Section 16 of the Computer Act was revised last December to protect the dignity, reputation and personal information of any “damaged parties”.

 

Section 14 of the legislation sets out other types of material considered illegal that also could be ordered destroyed by a court.

 

It covers false information, including any deemed likely to damage national or economic security or the public at large, information constituting a crime under the Penal Code, and information of a “vulgar” character.

 

Section 16 covers any image of another person that’s been electronically doctored in such a way that it could hurt that person’s reputation.

 

Section 16/1 says a court could order such data destroyed, order its ruling published in various media outlets as appropriate at the defendant’s expense, and order other remedial measures for damage caused.

 

Failure to obey a court order to destroy illegal data as covered in Section 14 and Section 16 will face punishment in half of what is stated as punishments for those violated the Section 14 and 16. The Section 14 is punishable by up to two years and six months in jail or a fine of up to Bt50,000, while Section 16 is punishable by up to one year and six months in jail or a fine of up to Bt100,000.

 

The rights group said keeping illegal data on a personal computer or online, whether for personal use or public access, was a violation of Section 16/2.

 

The revisions to the Computer Act gave the court the authority to order such data destroyed and specified that possession alone was a crime. Previously the court could only rule that posting such data online was a crime.

My computer holds information from Prayuth promising elections by at least 5 previous dates.  Would someone please charge him for distributing false information, totally wrecking any chance the country had of any reasonable reputation and his contribution for lowering the medium intelligence level of the human race. That is, if he qualifies.

They are indeed. Step outside your front door and sniff the wind. The smell of fear gets stronger with each  day passing. That nice Mr Prayuth and Mr Piggy must surely be having a really good home life right about now. Mum and the girls getting really stressed. Prem and one other yet to die and taking their own sweet time about it - one of which will call for a postponement of elections so perhaps that one won't happen just yet.

 

And the new head boy. Well... I'll bet he's feeling just peachy. I feel an extended overseas trip coming on.

This country is truly accelerating its descent into becoming a full-blown authoritarian police state. I' actually wanted to use another adjective instead of "authoritarian." It starts with an f. But spelling it out probably would violate this insane act, too.

 

I also better hurry and shred my foreign cooking recipes that make illegal use of Thai jasmine rice, because these surely must pose a tremendous danger for national security.

Thank you good sir, been looking for quite some time now for a comprehensive term to describe a fair lot of the news coming out of that corner in general ...

I admit, I confess: I am guilty of sometimes watching at home pics and clips of 'non-modest' naked (yes, over 18) ladies, maybe even having sex (the horror!), that while I should better contribute to the Thai illegal economy, going out to spend good money watching the same, 'live', behind the curtains of Thai 'special night venues'.

No, no, I am a liar, because there cannot be a thriving sex-industry in a country where prostitution does not exist...

The hypocrisy!

Where will they stop? Was the PM's quote about ladies wearing a bikini possibly a sign of a, deeper, personal, problem...?

He gave himself amnesty so he can't be charged. You, on the other hand, probably could be charged for keeping information on your computer that could defame him.

Who are the lunatics? The ones that administer lunacy as a new state religion or those that accept lunacy and support it by investing their live-savings in a country where lunacy reighns?


In the old days, it was sufficient to wear "rose coloured glasses". These days one needs very dark glasses in order not to see what is happening in Thailand. Good luck.

Good points. Regarding pornography, what is considered illegal? If someone has porn videos or photos on their computer, nothing under aged or too weird, is that a criminal offence in Thailand. Not very clear.
