Trump lawyer Giuliani defends legality of porn star payment

WASHINGTON (Reuters) - Hours after President Donald Trump said his lawyer Rudy Giuliani did not have "his facts straight," the former New York mayor issued a statement on Friday saying $130,000 (£96,000) in hush money paid to an adult-film star before the 2016 election was not an election law violation.

 

Giuliani on Thursday had connected the payment to Stormy Daniels by the president's personal lawyer, Michael Cohen, to keep quiet about a 2006 sexual encounter she said she had with Trump to the election, remarks that raised the possibility that the transaction violated federal election law.

 

"There is no campaign violation. The payment was made to resolve a personal and false allegation in order to protect the President's family. It would have been done in any event, whether he was a candidate or not," Giuliani said in a brief statement "intended to clarify the views I expressed over the past few days."

 

Giuliani in a TV interview on Thursday wondered what would have happened if Daniels' claim of an affair had come up in a debate between Trump and his Democratic opponent, Hillary Clinton, adding, "Cohen made it go away. He did his job."

 

In comments to reporters at the White House before boarding a helicopter, Trump seemed to undercut Giuliani, a former federal prosecutor who the president recently hired to represent him. Giuliani conducted a series of news media interviews this week that only intensified the controversy involving Daniels, whose real name is Stephanie Clifford, and other matters.

 

"Rudy is a great guy, but he just started a day ago. But he really has his heart into it. He's working hard. He's learning the subject matter," Trump said.

 

"He'll get his facts straight," Trump added, though he did not specify the statements by Giuliani, who joined the president's legal team on April 19, to which he was referring.

 

Giuliani late on Wednesday revealed that Trump had repaid Cohen for the $130,000 the lawyer had provided to Daniels. Trump previously had denied knowing about the payment.

 

The next morning, Trump said on Twitter that Cohen was paid back through a monthly retainer, not campaign funds, to stop Daniels' "false and extortionist accusations."

 

"COVERED WRONG"

 

Asked about the matter on Friday, Trump said, without explicitly mentioning Giuliani, that "virtually everything said has been said incorrectly, and it's been said wrong, or it's been covered wrong by the press."

 

In his statement on Friday, Giuliani said, "My references to timing were not describing my understanding of the President's knowledge, but instead, my understanding of these matters," but did not provide specifics.

 

Giuliani in an appearance on Fox News on Wednesday had said Trump fired James Comey as FBI director last year because Comey declined to state publicly that Trump was not at the time a target of the agency's investigation into Russia's role in the election.

Critics have pointed to Comey's firing as evidence of obstruction of justice by Trump.

 

In his Friday statement, Giuliani said it was "undisputed" that Trump had the constitutional power to fire Comey and that doing so has turned out to be "plainly in the best interests of our nation."

 

The Republican president, facing legal troubles on several fronts, also indicated he would be willing to be interviewed in Special Counsel Robert Mueller's investigation, but only if he knew he would be treated fairly. Mueller is probing potential collusion between the Trump campaign and Russia and whether the president has unlawfully sought to obstruct the investigation.

 

"Nobody wants to speak more than me ... because we've done nothing wrong," Trump said.

 

"I have to find that we're going to be treated fairly, because everybody sees it now, and it is a pure witch hunt," Trump added, while incorrectly saying that Mueller, a Republican former FBI director, has a "group of investigators that are all Democrats."

 

"If I thought it was fair, I would override my lawyer," Trump added.

 

During a pretrial hearing in Virginia on Mueller's charges against Trump's former campaign chairman, Paul Manafort, U.S. District Judge T.S. Ellis III openly questioned whether the special counsel had exceeded his prosecutorial powers by bringing the case.

Rudy has been unofficially in the role since mid april.

Over 2 weeks to get his head round the issues and get the facts straight. 

Mind you facts and trump are a very changeable and slippery combination.

Despite all that, a day after being let off the leash he utterly contradicts what trump and his minions have been trying to cultivate ( deny the shenanigans of the chief) .

Don't worry he means well amd he'll get it right.

Rudy the geriatric gunslinger trying to defend the indefensible inveterate truth violator.

Malcolm Nance has stated his belief that this is a ploy, a psychological game play on the minds of the 40% who, in varying degrees, support Trump.

That this is still going on after at least 2 weeks just goes to show what a pack of sad sacks the US media is. The whole world is laughing AT America for it's obsession with this silly nothing, when they should be concerned with actually important things.

In any sane country, it wouldn't even rate as gutter press trash.

I'm beginning to hope that Trump does decide to resign and let Pence deal with the mob. If that happens, they'll be sorry, and it's Trump that'll be laughing.

Anti Trumpers should be careful what they wish for ( perhaps they think that if Trump resigns or is impeached she gets to take over-555555555555555555 ). If Pence does take over, they'll be wishing Donald was still in charge. First people to get fired will be Sessions and Rosenstein, and then Mueller goes away as well. Yes, I dispute your take on this. Trump has been in the public eye for decades. You cannot read his mind, though I know some people think they can. In order to prove your case, you have to give evidence of what Trump was thinking. You also have to stare down the fact that there have been little to no stories like this about Trump before he got into politics. Logic dictates it's likely because other payments were made. Of course, you can also declare that Trump has never done anything like this before.

 

Either way, a person in the public eye is likely to make similar arrangements whether or not they are running for office. Now hopefully, you can do something better than repeat "liar". While it does look kinda cute to read, it doesn't work as a substitute for actual substance.

I believe you have touched on one of the problems with TDS. There is such an intense hatred of Trump, there is always a kneejerk reaction to turn anything he does into big news. Trump was elected even after the pu$$y tape came out. A logical person would realize trying to get traction with stuff like this simply won't work. And then of course there's my favorite story, Trump getting two scoops of ice cream.

 

Clearly we are not dealing with rational people. They are desperately playing checkers and aren't even doing that well. It's really quite HILLARYous.

Actually, it's quite easy to defend. First off, you can't just stroll into court and declare that since liberal *fact checkers* declare Trump has lied 3,000 times, he should be convicted. You have to make your case. Honestly, you don't seem to have even a rudimentary understanding of the facts or evidence needed.

 

In fact, anti-Trump obsession has made it even easier to defend. You people have come up with so many accusations of sexual impropriety, it makes it far easier to believe Trump would have made this arrangement whether or not he was running for office- if not having done so more than once already.

Well actually its big news everywhere , not surprisingly the president of the US is supposed to set a good example. In the UK our home secretary has been forced to resign for a single lie , Trump lies every single day yet you clearly think that is irrelevant , seems the British (despite our atheist tendencies ) hold the moral higher ground.

Yes, in the home of the gutter press ( UK ) the media are also cranking out anything that is anti Trump, But I never said the UK media was "sane" either.

I was in the UK when the HS resigned, and she didn't resign because of a "single lie". I suggest you do some research into the actual reasons for her resignation. She may not even have lied, when it comes down to the facts.

If politicians had to resign for lying, there wouldn't be a single one left.

Even if the funds came from Trump personally, if he paid to benefit his campaign he has to report the payment. Trump didn't and publicly stated he didn't know anything about the $130,000 payment.

 

What's not so simple is that Giuliani needs to be careful not to be so influenced by Trump to become a co-conspirator and engage in obstruction of justice with Trump to conceal the truth about the payment with the knowledge to protect Trump from a federal crime. Giuliani needs to refrain from interviews to voice his personal opinions while the case is before the court. He needs to act as Trump's attorney and not as his spokesman!
